Merry Month of May – Cambridge City Council May 20, 2013 Agenda Highlights

Amidst the flowering trees and the birds and the bees, springtime also brings the annual City Budget to the peaceful garden of Cambridge. The Big News is that the School Department Budget was not passed by the City Council’s Finance Committee amidst suggestions that important questions asked were not being answered. The 3-4-1-1 vote at the May 9 Budget Hearing [YES – Decker, Maher, Davis; NO – Simmons, Kelley, Cheung, vanBeuzekom; PRESENT – Toomey; ABSENT: Reeves] means that on the night when the final vote on the FY2014 Budget was expected to occur, the largest single component of the budget ($151 million) remains in committee. There appears to be trouble in the garden.

This might have been resolved on May 16 when there was a scheduled meeting of the Finance Committee if necessary, but Finance Committee Chair Marjorie Decker canceled that meeting. Instead of an actual meeting, we’ve been treated to a flurry of letters by city councillors and School Committee members posted here and on the Cambridge Chronicle website. [Mcgovern/Harding (May 13); Davis (May 13); vanBeuzekom (May 14); Cheung (May 14); Decker (May 15); Cheung, Kelley, Reeves, Simmons (May 16 and on this agenda); and Simmons (May 17).] Monday’s meeting agenda is interesting in that there are proposed policy orders that are incompatible. One order calls for the School Committee budget to be released from the Finance Committee and the unresolved issues discussed at a joint Roundtable meeting after the Budget is passed. The other order calls for the Finance Committee Chair to schedule a meeting of the committee before June 3 to resolve these matters prior to the Budget being passed by the City Council. The School Committee is not involved in these votes, but the co-chairs of their Budget Committee, Richard Harding and Marc McGovern, have been quite outspoken in characterizing the City Council’s actions as "reckless."

Here are the agenda items related to the current impasse:

Order #1. That the School Department budget be discharged from the Finance Committee and be referred to the full City Council for adoption at the City Council meeting of May 20, 2013.   Mayor Davis and Councillor Decker

That the City Council schedule a Roundtable Meeting on June 10, 2013 at 5:30pm to meet with the School Committee members, the Superintendent of Schools and the School Department as a follow-up meeting to discuss issues raised in the FY14 School Department Budget hearing held on May 9, 2013.   Mayor Davis

Order #17. That the City Council respectfully urges the Chair of the Finance Committee to convene further budget hearings, to allow for additional discussions, with the hope of resolving any outstanding concerns that individual City Councillors may have regarding the FY2014 School Budget.   Vice Mayor Simmons, Councillor Kelley and Councillor Cheung

Communications & Reports from City Officers #2. A communication was received from Councillors Cheung, Kelley, Reeves and Vice Mayor Simmons transmitting a copy of a letter to Mayor Davis regarding the Cambridge School Department budget. [This communication gives a very detailed list of grievances/concerns.]

Communications & Reports from City Officers #3. A communication was received from Jeffrey M. Young, Superintendent of Schools regarding the Cambridge School Department Budget.

Communications & Reports from City Officers #6. A communication was received from Mayor Henrietta Davis transmitting a copy of a memorandum from Carolyn L. Turk, Deputy Superintendent of Schools regarding Capital Improvements and Corresponding Educational Planning.

It will be interesting to see how this is resolved if, in fact, it is resolved. There has been a lot of talk around town about how the highly-touted Innovation Agenda may not be as rosy in its implementation as it was in its initial presentation. This may not be entirely apparent in the above communications, but the failure to pass the School Department Budget was most likely preceded by many phone calls and e-mail messages to city councillors from parents of children in the public schools.

In other matters, we have these items:

Order #2. That the City Manager is requested to develop a progress report on all of the non-zoning recommendations submitted by the Central Square Advisory Committee   Councillor Cheung, Councillor Reeves and Vice Mayor Simmons

This is important. Potential zoning changes to enhance retail and residential opportunities in Central Square will come before the City Council later this year and will hopefully pass in some form. However, many quality-of-life issues and actions that support the retail environment of Central Square are not part of the zoning code and should not be ignored while the zoning discussion continues.

Order #13. That the City Manager is requested to explore how the City of Cambridge can adjust the structure of its commissions to make them project-based and have the appropriate levels of funding for projects.   Councillor Cheung

It’s a little difficult to read between the lines of Councillor Cheung’s order. Taking a long, hard look at the structure and purposes of the City’s various non-regulatory borads and commissions is overdue, but this order could be little more than a prompt for the City Manager to hire an executive director for one particular board.

City Manager’s Agenda #4. Transmitting communication from Robert W. Healy, City Manager, relative to Awaiting Report Item Number 13-62, regarding a report on evaluating and incorporating traffic signaling during very low traffic volume times.

I found it interesting that the loop detector on Lee St. at Harvard Ave. is not on the list. Perhaps this is why it never registers the presence of my bicycle no matter how I position myself there. The loop detector on Lee St. at Broadway is on the list, but it does not detect bicycles. If you’re on a bike at a red light and there’s no way to make it turn green, what exactly are you supposed to do?

Unfinished Business #14. A communication was received from Donna P. Lopez, Interim City Clerk, transmitting a report from Councillor David P. Maher, Chair of the Ordinance Committee, for a public hearing held on Apr 3, 2013 to discuss an amendment to the Zoning Ordinance to create a new Section 6.100 Bicycle Parking, and to create a new definition for Bicycle Parking in Article 2.000, modify the yard standards in Article 5.000 as they relate to bicycle parking and modifying various sections of Article 6.000 to remove references to bicycle parking. The question comes on passing to be ordained on or after May 6, 2013. Planning Board hearing held Mar 19, 2013. Petition expires June 17, 2013. May 6, 2013 substituted language referred to Unfinished Business and remained on Unfinished Business.

Having spoken and written about this petition in the past, I’ll just make one simple suggestion for an amendment: Require that in any renovation of a residential or commercial property there be no net reduction in the potential for secure bicycle storage below the established minimum as proposed in this zoning amendment. That is, if basement or garage storage space is converted into living space this should not eliminate the potential of an appropriate amount of secure bicycle parking. – Robert Winters

The Board of The Dance Complex Announces the Appointment of Peter DiMuro as Executive Director

Located in the historic Odd Fellows Hall, in Cambridge, MA; The Dance Complex is a volunteer-based, artist run organization dedicated to promoting, advancing, and sponsoring artistic endeavors, creative work and education in dance and the movement arts. The organization, formed from the hard work and collaboration of members of the dance community, lead by pioneering founder Rozann Kraus, has been a model of a successful volunteer-based community engaged in dance study and making since 1991. Culturally, The Dance Complex is a process; we are members of the arts community establishing a resource, referral and support center that is responsive to a wide diversity of needs for both professional dancers and those who enjoy moving.

Peter DiMuro – Biography
Peter DiMuro gladly returns to Boston, where his first professional performance was with Gerri Houlihan’s Boston Dance Project at The Dance Complex of Cambridge. Ruth Birnberg, Susan Rose and Concert Dance Company (dancing the works of Deborah Wolf, Bebe Miller, Lucinda Childs, Wendy Perron, Keith Terry and many others) also provided Peter mentorship early in his career.

He has since woven a career as a choreographer, director, teacher, facilitator and arts practitioner/engager, touring and teaching internationally from Honk Kong to Pigeon Forge, TN, and places beyond and in-between. His Peter DiMuro Performance Associates and his fifteen-year collaboration, including 5 years as Artistic Director, with Liz Lerman Dance Exchange laid the foundation for his current creative umbrella, PDM: Public Displays of Motion, that develops and performs artistic works and cultivates dance/arts literacy, advocacy and engagement.

Peter’s work has appeared on tour and been commissioned by leading presenters, including The Kennedy Center/DC, Clarice Smith Performing Arts Center/MD, Tampa Bay Performing Arts Center, Dance Place/DC, DanceNOW at Joe’s Public Theatre/NY, Dance Umbrella, the Emerson Majestic, Bates Dance Festival, American Dance Festival, AURAS Dance/Lithuania, as well as on a nationally aired television commercial for the National Institute on Aging. As a collaborator and artistic lead at Dance Exchange, he directed seminal projects in the company’s history, including “The Portsmouth Naval Shipyard Project” and the 17-city tour of “Hallelujah Project”, both engaging communities in dialogue and action to make dance/theatre. “Near/Far/In/Out” and “Funny Uncles”, both dealing with issues bridging straight and LGBT communities, toured nationally. He directs and choreographs for theatre, stage, on-site, cabaret and coaches performance. For the Massachusetts Cultural Council, along with its then Executive Director Mary Kelley, Peter designed and executed the Elder Arts Initiative, offering exchange of ideas and training among artists and caregivers working with seniors.

He was named a White House Millennial Artist in 2000, a 1995 Mayor of Boston/ProArts Arts Award recipient, and his work has received grants from the National Performance Network, the Mass Artists’ Foundation, Mass Cultural Council, MetLife Foundation and the National Endowment for the Arts. In 2010, he represented the US as an emissary for the Department of State in Madrid, teaching and adjudicating an international competition for emerging artists. Peter has taught several summers at the Cornerstone Theatre Institute/LA, American Dance Festival and Bates Dance Festival and adjudicated several American College Dance Festival Association regional conferences. He has been affiliated with Tufts University (artist in residence), Drexel University (associate professor), Michigan State University (guest artist/commissionee), American University, Emerson College, Boston University, The Boston Conservatory, and several college programs throughout his career.

A believer in the multiple roles artists develop to re-create definitions of their own artistry and the field’s re-definition of artmaking, Peter created several programs for artist development and audience literacy through his directorship of Dance/MetroDC, a local service organization and a regional branch of Dance/USA. He has served on the boards of the Dance Umbrella/Boston, National Performance Network, Dance/USA, Capitol Region Educators in Dance Organization, and as a mentor and panelist for New England Foundation for the Arts, Maryland State Arts Council, D.C. Commission for the Arts. He is host and creative consultant to VelocityDC, an annual DC based showcase for the region’s eclectic dance companies.

He received an MFA in Dance from Connecticut College under Martha Myers; a BFA in Theatre from Drake University, early study with Sally Garfield, and continued study in New York, Boston and at the American Dance Festival.

Originally from Round Lake, IL (population, circa 1970: 250), he is the youngest of three children, the son of the Chief of Police (Dad, born in East Boston) and a machinist/gal Friday (Mom). He has a niece named for the Crayola crayon, Sienna.

Resolution #15. Thanks to Thomas W. Anninger for his years of service as a member of the Cambridge Planning Board.   Councillor Maher

Though the Planning Board has been short a few members lately, it’s been functioning like a well-oiled machine. Tom Anninger’s exit from the Board is a real loss, but the newly appointed members appear to be very qualified and should prove to be excellent additions. They’ll arrive just in time for some serious discussions about possible plans for Central Square and other areas that were part of the recent K2C2 study. It is noteworthy that the recent January 7 Order #4 strongly urged the City Manager to fill the two vacancies on the Planning Board with people "who have a background in, or association with, the skilled labor and building trades." None of the three appointees seem to fit that description, and that’s probably a good thing.

This marks the 4th straight year for these water rates, i.e. no increases for three years from the level set for FY11. This is the first increase in the sewer rate after two consecutive years of no increases.

Order #11. That a one-time suspension of Council Rule 23B be allowed, for the broadcast of the Fri, Mar 22nd, 9:30am Ordinance Committee Meeting (a meeting to discuss issues relating to the MIT PUD-5 zoning petition).   Councillor vanBeuzekom

As a group, these are probably the most significant items on the agenda. The Council will most likely pass the MIT/Kendall petition to a 2nd Reading in order to get it in the queue for possible ordination in a few weeks. The Ordinance Committee is still deliberating the issue, and it will surprise no one if there are additional tweaks to the zoning language before the matter comes to a final vote.

One yet unresolved issue is the matter of how MIT will respond to demands for additional on-campus and near-campus housing for graduate students and post-docs. It’s a legitimate question, and the MIT administration is seriously analyzing this now. The question of whether this housing should be intertwined with the zoning petition is somewhat unclear, especially since MIT has numerous other options for where such housing could be constructed if their analysis proves the need. It’s unfortunate that this issue has been latched onto by at least one new Council candidate who has about as much familiarity with MIT as a fish has with a bicycle.

Applications & Petitions #6. A zoning petition has been received from Charles D. Teague, et al., requesting the City Council to amend the Zoning Ordinance to clarify existing law so that said law can be enforced by inserting text after Section 7.20 Illumination, with the existing text to be retained and labeled as Section 7.23 Lighting Restrictions for Residential Districts.

Yup, another zoning petition, and a pretty anticlimactic one after the Forest City petition and the MIT/Kendall petitions that some have used to define their political campaigns.

Order #1. That the City Manager is requested to report back to the City Council and the Cambridge community on the current status, to the extent that it is possible, of the investigation into the June 3, 2012 murder of Charlene Holmes.   Vice Mayor Simmons

I am grateful to Vice Mayor Simmons for bringing this issue back into public view. It is incredibly disturbing to think that this cold-blooded murder in front of witnesses is still unresolved almost a year later.

Order #7. That the City Manager is requested to confer with the Department of Public Works as to the feasibility of installing fiber-optic conduits when doing sewer reconstruction and report back to the City Council.   Councillor Cheung and Councillor vanBeuzekom

The fact is that these fiber-optic conduits are sometimes run inside the sewers. Don’t worry, you won’t see that stuff and it won’t get all over your data.

Order #9. That the conversion of further soccer fields at Danehy Park to artificial turf be delayed until further study of the impact of artificial turf on player’s health be completed along with a report which quantifies the decreased use of the more fragile grass playing fields throughout the city as a result of the installation of artificial turf playing fields be prepared by the Recreation Department.   Councillor vanBeuzekom

Committee Report #1. A communication was received from Donna P. Lopez, Interim City Clerk, transmitting a report from Councillor Leland Cheung, Chair of the Neighborhood and Long Term Planning Committee, for a public meeting held on Feb 5, 2013 to discuss the long-term impact of grass versus artificial turf at Danehy Park.

Though I have not been following this issue, the committee report makes clear that this is a Big Issue for a lot of people – especially the soccer crowd. It does seem a bit weird that Councillor vanBeuzekom is bringing up the concern that "this infill material may contain polycyclic aromatic hydrocarbons (PAHs), phthalates, benzene, benzothiazole and other toxic derivatives that may present a health risk to residents" as justification for delaying the installation. Is this out of concern for health risks or just opposition to replacing natural grass with artificial turf? I’ll go with the majority of soccer players. If they’re OK with it, then go for it.

Order #10. That the City Manager is requested to offer City of Cambridge engineering expertise to the City of Belmont so that both cities may work together to ensure that the residents of Cambridge, Belmont and Arlington be protected from the impacts of flooding in Alewife SubWatershed and report back to the City Council.   Councillor vanBeuzekom

On the surface, this certainly seems like a good idea. I always wonder whether the real intention of Orders like this is to delay development proposals or whether there are serious environmental concerns. In matters such as this we also get a clear view of how lacking the regional planning can sometimes be in these parts. Instead, we talk about loaning our expertise to neighboring towns.

Committee Report #2. A communication was received from Donna P. Lopez, Interim City Clerk, transmitting a report from Councillor David P. Maher, Chair of the Ordinance Committee, for a public meeting held on Feb 6, 2013 to receive a briefing on the recommendations of the C2 Report.

There’s also a Roundtable City Council meeting coming up on Wed, Mar 27 at 5:30pm on the report of the Central Square Advisory Committee 2011/2012. This is pretty important stuff. Some choose to see only danger and fear of change; while others see opportunity. I count myself in the latter group. The actual zoning recommendations yet to come out of CDD are eagerly awaited. – Robert Winters


Quick Notes on what went down at the Mar 18 City Council meeting:

1) Many people showed up to protest the impending termination of the Longy School’s Preparatory and Continuing Studies program. The City Council’s University Relations Committee will address this at a meeting on Wed, Mar 20 at 2:00pm in the Sullivan Chamber of City Hall.

2) Throngs of soccer players, parents, and coaches came out to question Councillor vanBeuzekom’s Order #9 that recommended delaying the installation of artificial turf on soccer fields at Danehy Park. The Order was subsequently withdrawn. (It would likely have been defeated.)

3) Open Houses on the MIT/Kendall Square Initiative (zoning petition) are scheduled for Sat, Mar 23 from 10:00am to noon and Tues, Mar 26 from 6:00pm to 8:00pm at One Broadway, 1st Floor, next to Firebrand Saints. Look for the blue windows.

4) There was a somewhat disjointed discussion on the appropriateness of a proposed Ordinance Committee roundtable meeting this Fri, Mar 22 at 9:30am to discuss the details of the MIT/Kendall petition. The debate centered on whether it should be televised and whether public comment should be permitted. The procedural compromise was to change this to a City Council roundtable meeting (which are not televised and where public comment is not permitted). Ordinance Committee Chair David Maher promised that there would be another Ordinance Committee meeting on this topic prior to a final vote on ordination. It was also stated that this petition will expire on April 15 rather than April 24 as previously established. Apparently even though state law sets the deadline at 90 days after its first Ordinance Committee hearing, section 1.52 of the City’s zoning ordinance sets the deadline at 90 days after its initial Planning Board hearing (who knew?). The Law Dept. recommended the Apr 15 deadline. After the discussion the City Council passed the petition to a 2nd Reading. This puts it in the queue to be voted for ordination after Mar 28 and before the Apr 15 expiration date.

5) Councillor Decker announced that the state has designated Homeowners Rehab, Inc. (HRI) as the agency to negotiate the sale of the 2 Mt. Auburn St. housing currently owned and managed by Harvard University. She indicated some hope that good news may follow regarding the long-term affordability for tenants of this building. – RW (additions and corrections welcome)

And the Oscar goes to…. Feb 25, 2013 Cambridge City Council Agenda Highlights

There are a few major items on the agenda this week: (1) The possible signing of a 3-year contract with Rich Rossi as the next City Manager (starting July 1), and (2) a possible vote on ordination of the Forest City zoning petition. Starting with the big items:

Communications and Reports from City Officers #3. A communication was received from Councillor David P. Maher transmitting the proposed contract between the City of Cambridge and Richard C. Rossi as the next City Manager for the City of Cambridge. [original PDF]

The contract offers a very generous salary for each of the next 3 years, but it’s also interesting in that part of the deal is that Rich Rossi gives up an enormous amount of accrued value in compensatory time and sick leave gathered over his decades of service. The City gets a good deal in the short term, and Mr. Rossi potentially gains in the very long term due to an enhanced pension. Read the contract and draw your own conclusions. I’m sure we’ll hear public comment from the usual suspects. The communication from Councillor Maher to Councillor Kelley is delightful.

Unfinished Business #10. A communication was received from Paula Crane, Administrative Assistant, Office of the City Clerk, transmitting a report from Councillor David P. Maher, Chair of the Ordinance Committee, for a public meeting held on Jan 30, 2013 to continue discussions on a zoning petition filed by Zevart M. Hollisian, Trustee of Garabed B. Hollisian Trust and L-Z Realty Trust and Seth D. Alexander, President, MIT Investment Management Company to amend the zoning Ordinance and Map by extending the Cambridgeport Revitalization Development District from Green Street out to Massachusetts Avenue in the area adjacent to Blanche Street; said petition includes a map and a commitment letter. The question comes on passing to be ordained on or after Feb 25, 2013. Planning Board hearing held Jan 8, 2013. Petition expires Apr 17, 2013.

Manager’s Agenda #13. Transmitting communication from Robert W. Healy, City Manager, relative to Council Order No. 14, dated 2/11/13 regarding the Forest City Petition and letter of commitment to ensure that it is consistent with other letters of commitment, and Council Order No. 15 dated 2/11/13 regarding whether the Forest City Petition would be considered spot zoning. Communications and Reports from City Officers #4. A communication was received from Councillor David P. Maher transmitting a proposed amendment to the Forest City Zoning Petition and the Letter of Commitment as revised by Forest City to be accepted and incorporated into and made part of the Zoning Ordinance.

This is the Forest City petition and it could come to a final vote at this meeting. It’s been before the City Council in one form or another for about two years now, so please laugh out loud when anyone says that they need more time to study the issue. The votes of most of the city councillors have not changed since early in the process. It’s always been a matter of whether one or two councillors would value the overall public benefit of this petition over their need to cater to a few influential political supporters. The future debate over the potential for new housing development in and around Central Square is yet to come, and it will be a relief if we can allow the redevelopment of that long-neglected stretch of Mass. Ave. to proceed so that we can move on to the more important stuff.

Don’t be surprised if public comment turns into a circus with fear-mongering, accusations of corruption, and speeches by aspiring Council candidates all fighting over the same pool of a thousand votes.

Manager’s Agenda #2. Transmitting communication from Robert W. Healy, City Manager, relative to Awaiting Report Item Number 12-65, regarding a report on Sunday openings at the Library.

The bottom line is that even if everyone would love expanded Sunday Library hours, you still need workers to staff the place and that’s not necessarily a sure thing.

Manager’s Agenda #7. Transmitting communication from Robert W. Healy, City Manager, relative to Awaiting Report Item Number 12-90, regarding a report on Executive Session to discuss lawsuits.

I’m not sure which lawsuits this refers to, but there will always be some people who want to milk Mother Cambridge.

Manager’s Agenda #15. Transmitting communication from Robert W. Healy, City Manager, relative to the City of Cambridge retaining the rare distinction of being one of 37 municipalities in the United States with three AAA ratings from the nation’s three major credit rating agencies.

We get a similar report every year around this time. Though it may seem routine, it really is something worth celebrating. I wonder how many of the aspiring Council candidates actually understand its significance.

Happy birthday, Walter. You were the first person I ever met at the Count at the old Longfellow School about 30 or so years ago. I don’t know whether I should thank you or blame you for encouraging my interest in the Cambridge elections.

Resolution #15. Congratulations to Saul Tannenbaum on launching a daily compilation of local news in and out of Cambridge titled Cambridge Happenings.   Councillor Cheung

Though Cambridge Happenings is what they call a news aggregator (as opposed to a content provider), our good pal Saul is a pretty damn good content provider as well. Check out Saul’s CCTV site for a sample.

Order #3. That the City Manager is requested to confer with the Election Commission and Information Technology Department on the feasibility of passing an ordinance that requires landlords to provide new tenants with a voter registration form when they move into a property in the City of Cambridge.   Councillor Cheung

Order #6. That the City Manager is requested to confer with the Election Commission regarding the feasibility of including voter registration forms in the annual census mailings.   Councillor Cheung

These are highlighted because of all the recent interest in elections – not just this year’s municipal election but the game of musical chairs that has been set off by the exit of Senator John Kerry to become Secretary of State. Because Massachusetts is effectively a one party state with the custom of Democrats not challenging incumbent fellow Democrats, it becomes a cascading free-for-all whenever a vacancy occurs. I have no idea whether Markey or Lynch will get the party blessing to become Senator, but if and when one of them is elevated another vacancy for a U.S. Congress seat will then occur. That’s when things could get very interesting. Will one of our State Reps. or State Senators go for the seat? Yes. Maybe one of our city councillors? If a State Rep. or State Senate seat opens up, perhaps a city councillor will go for it (and maybe create a City Council vacancy). In Massachusetts, we get a cascade of vacancies and special elections instead of actual contested elections like you might have in a two-party state. It’s a sad state of affairs.

Order #9. That the City Council schedule a roundtable/working meeting for Wed, Mar 27, 2013 at 5:30pm in the Sullivan Chamber to discuss the Central Square Advisory Committee Report.   Mayor Davis

It’s about time. Remember that the Central Square Advisory Committee Report is ultimately just a collection of good ideas and suggestions. The Community Development Department is now drafting actual proposed zoning language that should enter the public arena sometime this summer.

Order #12. That the City Manager be and hereby is requested to instruct the City Solicitor and the appropriate city staff to evaluate the feasibility of revising the PTDM ordinance to include Parking and Transportation Demand Management Plans for "residential developments."   Councillor vanBeuzekom

I’m not really sure what Councillor vanBeuzekom is looking for here. Housing development generally has a relatively low impact on vehicle trips compared to most commercial development. I suspect this may be part of the budding anti-housing movement currently being pushed by people who paradoxically call themselves housing activists.

Committee Report #2. A communication was received from Donna P. Lopez, Interim City Clerk, transmitting a report from Councillor Leland Cheung, Chair of the Neighborhood and Long Term Planning Committee, for a public hearing held on Feb 14, 2013 to conduct a follow-up meeting on the development in Kendall Square.

This was an incredibly interesting meeting held in the Cambridge Innovation Center (CIC) in Kendall Square. I have to confess that it was my first visit to the CIC. When you arrive you enter your name into a computer and are issued a printed name tag that has a number corresponding to how many times you’ve been there. I had a #1 on my badge, but it looked especially appropriate to see the badge of current Council candidate Tom Stohlman #1. I believe Leland Cheung had a #37 next to his name – not so good in a municipal election year.

It was fascinating to see the beehive of activity in the CIC – almost like a flea market of entrepreneurs busy as can be in chaotic productivity. I may just have to go back there one of these days. – Robert Winters

A Sampler from the Jan 7, 2013 Cambridge City Council Agenda

The 2013 City Council season opens this Monday with little at bat and a lot on deck. Here is a sampler of some interesting agenda items:

Communications #4. A communication was received from Tom Stohlman transmitting a copy of a letter to Ms. Amy Nable of the MA Attorney General’s Office in response to his Open Meeting Law Complaint.

This is an interesting interpretation of the Open Meeting Law. It seems to suggest that the only legitimate legislative actions the City Council or any public body can propose is the kind that’s dreamt up in a vacuum by an individual or that emerges spontaneously on the floor of the City Council. I don’t think ANY legislative body works this way nor do I think any effective organization or group of individuals works this way. People talk to each other. Elected officials talk to each other (or at least we hope this is the case). Sometimes a consensus around a good idea develops before the whole group gets together. The public gets a chance to chime in, discussion ensues, and a vote is taken. What is to be gained by turning elected officials into robots in straitjackets? What is so offensive about the practice of allowing councillors to individually sign on as sponsors of a City Council Order prior to voting on the record in favor of the Order? If you are unhappy about the decision to hire Rich Rossi as City Manager for a few years, so be it, but why make such a whine out of sour grapes?

Resolution #15. Resolution on the death of Karen Klinger.   Councillor Cheung

Karen Klinger, photo from CCTVWhen I receive email messages from Cambridge people, I confess to classifying the senders mainly into three categories: Friends, Civics, and Politics. Only my real friends are classified as Friends. I lump much of the mail I receive into the Politics category and, quite frankly, I don’t put a lot of weight in that stuff. The special category is Civics – for people who are really trying to do all the best things a citizen should do. These are the constructive people, the thoughtful people, and many of them I eventually call Friends. Karen Klinger was a Civic person, well on her way to being a Friend – a constructive and thoughtful citizen who did not participate in civic life merely to inflate her ego or to obstruct whatever comes along. Karen and I would often ride together on the bike rides sponsored twice per year by the Cambridge Bicycle Committee and we would catch up on things as we rode through the streets of Cambridge.

When I heard that Karen had died after an extended illness, I looked back at some of the messages we had exchanged over the last few years. Just two years ago when fellow cyclist Henry Lewis died suddenly, Karen wrote these haunting words: "That’s so sad about Henry Lewis. What happened? He looked to be the picture of health on the Bow Tie Ride. A very enthusiastic, charismatic guy. I always find it especially shocking when seemingly healthy people who are surely younger than I am suddenly die. I can’t get the image of him, enthusing about the ride and the one coming up next spring–with a music theme–out of my head." Karen was also a very enthusiastic, charismatic gal and I will especially miss her when riding in the next Cambridge Bike Tour on May 13.

Order #1. That the City Manager is requested to work with the appropriate city staff to provide a report to the City Council explaining the SOV target rate that has been established for the City of Cambridge; data that explains how the City of Cambridge is doing in relation to meeting its SOV target rate; and future plans to reduce the actual SOV rate including barriers to achieving as low a rate as is possible.   Councillor vanBeuzekom

Nothing unusual in this Order. It’s highlighted primarily to note how certain issues and language seem to rise and fall in importance over the years. It wasn’t so long ago that the City Council often referred to the problem of "single occupancy vehicles." Much of those concerns were incorporated into the City’s Vehicle Trip Reduction Ordiance that effectively replaced the old Interim Parking Freeze. That ordinance drives much of City policy today. We don’t really hear the phrase "single occupancy vehicle" any more. The language today tends to focus on larger themes like energy efficiency, climate change, LEED standards, smart growth, and transit-oriented development. I remember a day 24 years ago when recycling was the new wave. We really have come a long way since then.

Order #4. That the City Council go on record strongly urging the City Manager to fill the two vacancies on the Planning Board with people who have a background in, or association with, the skilled labor and building trades.   Vice Mayor Simmons and Councillor Cheung

I beg to differ. The Planning Board ideally consists of objective, fair-minded people who bring a range of relevant skills to the business of planning the future of the city and its urban design. What exactly is the value added by insisting on having skilled labor and building trades represented on the Planning Board? Will there be another Order forthcoming urging that representatives from the life sciences be appointed to the Planning Board in recognition of their major presence in Kendall Square and elsewhere? Why not have representatives from the universities in recognition of the dominant role they play in Cambridge? Those vacancies should be filled as soon as possible, but the pool should not be restricted to any specific interest group.

Committee Report #1. A communication was received from Donna P. Lopez, Interim City Clerk, transmitting a report from Councillor Leland Cheung, Chair of the Neighborhood and Long Term Planning Committee, for a public hearing held on Dec 12, 2012 to receive an update on the long-term vision for Kendall Square.

There’s not much to add other than to highlight all the potential activity that is now on deck. New buildings are under construction in Kendall Square and there may be other significant changes there from whatever emerges from the recently re-filed MIT Kendall Square zoning petition and the concurrent planning process now underway. Meanwhile, at the other end of Main Street, the Fennell properties – all 15 of them in the Lafayette Square area – recently sold for $32 million to New Jersey’s Normandy Real Estate Partners which is teaming up with Twining Properties, the New York firm that brought the Watermark apartment towers along with new retail and restaurant offerings to Kendall Square. Great things (or horrible things) could come of all this, but it’s guaranteed to not set well with many activists. It should keep things peppered up around here for the next few years.

Committee Report #2. A communication was received from Donna P. Lopez, Interim City Clerk, transmitting a report from Councillor David P. Maher, Chair of the Government Operations and Rules Committee, for a public meeting held on Dec 19, 2012 to introduce Attorney Elizabeth Valerio, who will represent the City Council, in negotiations with the next City Manager, Richard Rossi.

The specifics of the proposed contract with our next City Manager Richard Rossi are due to appear sometime this month.

Miscellaneous #2. Transmitting communication from Robert W. Healy, City Manager, relative to the City of Cambridge Comprehensive Annual Financial Report for July 1, 2011 – June 30, 2012.

There are a few City publications that are worth perusing, and this is one of them. If you really have time to waste, you can also check out the City’s annual line item budget at the Cambridge Public Library. That’s the one that gives the names and salaries and benefits of all the City’s full-time employees. Or you could go hiking. I’ll choose the latter.

Prospect Pubs, Planning, and Pilot Programs – Dec 10, 2012 Cambridge City Council Agenda Highlights

It will be difficult to top last week’s excitement when the City Council voted 8-1 to appoint Rich Rossi to succeed Bob Healy as City Manager starting July 1, 2013. The only other point I’ll make about that excellent decision is directed to those who have suggested that the appointment be an "interim" or "acting" appointment. This is not the lifetime appointment of a Pope or a Supreme Court Justice. Just because Bob Healy has served for over three decades does not change the fact that for his entire term, contract or no contract, Bob Healy served "at the pleasure of the City Council." The same will be true of Rich Rossi. There is nothing interim nor permanent about the job. Unless someone is filling in due to an unexpected departure, you’re either the City Manager or you’re not. The public elects the City Council who then hires their choice of City Manager. The democracy part takes place every 2 years in November. If anyone is especially passionate about this, you can pull papers next July to be a City Council candidate or start recruiting candidates you can support.

Here are the items that I found interesting:

Manager’s Agenda #1. Transmitting communication from Robert W. Healy, City Manager, relative to a Planning Board recommendation on the Patty Chen, et al Zoning Petition.

The Council has until Feb 12, 2013 to pass this petition that would slightly expand the set of streets on which bars and alcohol-serving entertainment venues may locate their entrances to include one block of Prospect Street north of Mass. Ave. The Planning Board supports it, and little or no objection from the public has been heard. It’s a good idea and should be approved forthwith. People are waiting to open for business.

Manager’s Agenda #4. Transmitting communication from Robert W. Healy, City Manager, relative to a report from the Department of Public Works that summarizes the results from a feasibility study regarding a possible pilot program for curbside food scraps collection from residents for composting.

If implemented, the pilot will run one day a week for one year. We estimate 2 tons per day of food and 124 tons per year. This assumes 800 households generating 10 pounds of food scraps per week with an 85% participation rate and 70% setout rate. To ensure an efficient pilot route, we will choose a neighborhood within one collection day. We would target a range of housing types including single-family homes and residential buildings with up to 12 units… Households participating in the pilot will receive a kitchen scrap container and a year’s supply of 3-gallon compostable bags to line the container…. If the pilot is successful, a voluntary citywide program would be phased in by collection day to get enough participation among households to achieve minimum route density.

This is an exciting development. Many of us will continue to compost organics in our backyards, but if the pilot is successful and the program can eventually be expanded to a citywide program, this will be a great service to those who either cannot set up composting at home or who may prefer an organics collection service. Bring back the honey wagon! What was old is new again.

Applications and Petitions #2. A zoning petition has been received from Zevart M. Hollisian, Trustee of Garabed B. Hollisian Trust and L-Z Realty Trust and Seth D. Alexander, President, MIT Investment Management Company to amend the Zoning Ordinance and Map by extending the Cambridgeport Revitalization Development District from Green Street out to Massachusetts Avenue in the area adjacent to Blanche Street; said petition includes a map and a commitment letter.

This is essentially the same petition that was filed last March together with the committments subsequently made in July prior to the expiration of that petition. The main argument then for why the petition should be allowed to expire was that the Central Square Advisory Committee 2011/2012 was still in the process of formulating its recommendations. That process is now complete, so the time is right to revisit this proposal.

Communications #1. Open Meeting Law Complaint filed by Tom Stohlman.

Order #9. That the City Clerk, in consultation with the Law Department, draft a response regarding an Open Meeting Law complaint received on Dec 4, 2012 for the City Council’s consideration at its Dec 17, 2012 City Council meeting in order to meet the Dec 21, 2012 deadline.   Mayor Davis

It is doubtful that there is any merit to the claim that the Open Meeting Law was violated in the drafting of last week’s Order on the appointment of Rich Rossi as City Manager starting next July. As City Clerk Donna Lopez clearly explained last week, the Order was drafted by a minority of City Council members and was submitted to the City Clerk who then circulated the Order to provide other councillors the opportunity to sign on as cosponsors. This is standard procedure. There were neither meetings involving a majority of councillors nor were there "serial meetings." It is likely that some councillors had conversations on the topic, but the intention of the Open Meeting Law has never been to require elected officials to avoid all conversation except when meeting in a public session.

Order #4. That the City Manager is requested to report back to the City Council on the cause and other details of the power outage on Nov 29, 2012.   Mayor Davis
