MLK School Groundbreaking

June 17, 2013 – City and School Officials held a groundbreaking ceremony for the new Dr. Martin Luther King, Jr. Elementary School & Putnam Avenue Upper School Monday, June 17. The existing structure at 100 Putnam Ave., Cambridge will be replaced with a new energy efficient NET ZERO building design. The final construction phase shall begin following final project bids due in December 2013 and occupancy is scheduled for September 2015.

Almost Summer – June 17, 2013 Cambridge City Council Agenda Highlights

Just a few brief, late comments this time around. I’ve been busy doing some (free) consulting work for the good folks in Minneapolis analyzing the effect of the number of permitted rankings in Instant Runoff elections. You may find this uninteresting, but it really floats my boat. Perhaps I’ll share some of this information with all my Cambridge friends later. Meanwhile, the Sullivan Chamber will rock tonight (he says tongue in cheek) with the following thrill-a-minute items:

Manager’s Agenda #5. Transmitting communication from Robert W. Healy, City Manager, relative to the appropriation of $40,000 from the Cambridge Community Foundation to the Department of Human Service Programs Salary and Wages account and will support the ongoing programming for families who have participated in the Baby University program.

It’s good to see this program coming along. It grew out of an initiative of Councillor Reeves a few years ago.

Manager’s Agenda #21. Transmitting communication from Robert W. Healy, City Manager, relative to an appropriation of $250,000 from Free Cash to the Public Investment Fund Finance Department (Information Technology) Extraordinary Expenditures Account which will provide funds to address recommendations of the Gartner Strategic Planning Report over the next 6-12 months.

Committee Report #2. A communication was received from Paula Crane, Administrative Assistant, City Clerk’s Office, transmitting a report from Councillor Leland Cheung, Chair of the Cable TV Telecommunications and Public Utilities Committee for a public meeting held on May 23, 2013 to assess the findings and recommendations of the Gartner Report on the City of Cambridge’s Information Technology Strategic Plan.

I’ll leave it to Saul Tannenbaum to discuss the details, but the two items "Implement Citywide Governance Model" and "Public Input to Governance Model" are intriguing.

Manager’s Agenda #29. Transmitting communication from Robert W. Healy, City Manager, relative to a motion to amend a previously adopted order to strike out the sum of $92,715,930 in the Public Investment appropriation and request the adoption of the substituted appropriation order for the Public Investment Fund in the amount of $34,407,930.

This appears to be as much a recording/bookkeeping error as anything else. We’ll still be spending the same amount of money on Public Investments.

Charter Right #1. That the City Manager is requested to confer with the State Auditor’s Office to determine if the state of Massachusetts will fund the costs incurred by the city when it assesses and establishes full and fair cash value for tax-exempt properties within the City of Cambridge even though the city cannot collect taxes from said properties. [Charter Right exercised by Councillor Decker on Order Number Five of June 3, 2013.]

Order #19. That the Cambridge City Council go on record to urge the members of the Massachusetts Joint Committee on Revenue to report favorably MA Senate Bill 1308 and MA House Bill 2642 regarding payments in lieu of taxation of organizations exempt from property tax.   Councillor vanBeuzekom, Councillor Cheung and Councillor Kelley

Last weeks Order that was delayed and this week’s new Order seem interrelated. An accurate assessing of tax-exempt property would only be useful if it was used for determining an actual tax. Seems contradictory, doesn’t it? If a law is passed mandating in-lieu-of-tax payments, then it’s no longer "in lieu of tax". It’s just a different tax classification – like commercial vs. residential vs. industrial vs. agricultural. The key phrase is "These two bills, identical in content, will allow a municipality, upon acceptance at the local level, to implement a program through which nonprofits will make an annual PILOT payment to the municipality equivalent to 25 percent of the amount that the organization would have been assessed on real and personal property if it were not exempt from taxation." In other words, it would be taxable at a different rate. Who knows what the Legislature will do, but this idea seems Dead On Arrival.

I don’t usually highlight birthday announcements, but I lift my glass to Harvard Square long-timer and photographer Bob Marshall and to long-time activist Bill Cavallini who now resides in, I believe, Somerville. He’s still a Cantabrigian at heart.

Order #5. That the City Manager is requested to confer with the necessary departments as to appropriate ways for residents to be involved throughout the development of the Watertown-Cambridge Greenway and publicize such a means to members of the community.   Councillor Cheung

Yup – Shout it from the rooftops. This bicycle/pedestrian connection will be a Good Thing.

Order #6. That the City Manager is requested to confer with the appropriate departments as to the possibility of installing a sign on Peabody Terrace that indicates that bicyclists’ use of the roadway is always permitted.   Councillor Cheung

This is how you tell that Councillor Cheung and his helpers haven’t been around so long. Peabody Terrace is Harvard-owned housing in the Riverside neighborhood. He’s probably thinking of Peabody Street – the actual name for a section of road next to Harvard Yard by the Harvard Tunnel. Maybe his IPhone told him the name. [I just learned that the mixup occurred in the City Clerk’s Office, so Councillor Cheung’s Cantabrigianism remains intact!]

Order #8. That the City Manager is requested to direct Police Commissioner to ensure that no license plate readers become operational for any reason whatsoever, including testing and training, until after the Cambridge Police Department has formulated and publicly posted a policy on their use and management of relevant data   Councillor Cheung and Councillor Kelley

Nab the lawbreakers and leave the decisions to the police. There are better things to worry about than getting your license plate photographed.

Order #9. That the City Manager is requested to confer with the appropriate parties and report back to the City Council with an update on the Constellation Center.   Councillor Toomey

Good question, and the property owner will likely continue to have no response.

Committee Report #4. A communication was received from Donna P. Lopez, Interim City Clerk, transmitting a report from Councillor Leland Cheung, Chair of the Neighborhood and Long Term Planning Committee, for a public meeting held on Apr 17, 2013 to conduct a joint public meeting with the Cambridge Redevelopment Authority (CRA) to review the powers and potential of the Cambridge Redevelopment Authority as it pertains to future development plans throughout the City of Cambridge.

The future of the Cambridge Redevelopment Authority is an open question. It seems like they will become a major force in promoting housing development in the greater Kendall Square area over the next decade, but they could also play a significant role in facilitating change in the Central Square area.

Committee Report #6. A communication was received from Donna P. Lopez, Interim City Clerk, transmitting a report from Councillor Craig Kelley, Chair of the Public Safety Committee, for a public meeting held on June 5, 2013 to continue to discuss the proposed City of Cambridge Security Camera Policy, Draft 2.

Just do something, boys and girls. Switching on the cameras makes a lot of sense and the proposed policy seems to balance all interests.

Communications & Reports from City Officers #1. A communication was received from Mayor Henrietta Davis transmitting a letter from Hanne Rush, Assistant Attorney General to Nancy Glowa, City Solicitor regarding the Open Meeting Law Complaint.

The Stohlman complaint got a favorable response from the AG’s Office, though the matter that spurred the complaint stands (appointment of the City Manager). I doubt whether we’ll see many cosponsored Orders and Resolutions in the future as the accusations will likely fly that discussing any proposal violates the Open Meeting Law. Perhaps elected officials should just run away from each other from now on if they see each other any time other than on a Monday night.

Communications & Reports from City Officers #2. A communication was received from Vice Mayor E. Denise Simmons transmitting a copy of a letter sent to Councillor David Maher, Chair Government Operations and Rules Committee seeking an update on Community Mitigation.

The Vice-Mayor is correct. The promised discussion regarding a more consistent way of handling mitigation funds, including money already raised, is long overdue. – Robert Winters

Kendall Square Urban Renewal Project: Six Pivotal Episodes

In 2012, the Cambridge Civic Journal published "Kendall Square Urban Renewal Project: Initial Years, 1963 to 1982". The following commentary focuses on six pivotal episodes during the 1963-1982 time period which provided the impetus for major development in the Kendall Square Urban Renewal Project. Successful development of the Kendall Square Project was a major factor in helping to attract high-tech companies to locate in the eastern sector of the City of Cambridge. Today there are over 163 institutional research companies within a 1-mile radius of the Kendall Square Urban Renewal Project area (Source: Boston Consulting Group, Capital IQ DB, U.S. Census Bureau, National Science Foundation.)

The episodes are described in chronological order.

1. Conceptualization and initiation of the Kendall Square Urban Renewal Project

In 1963, Mr. Robert F. Rowland, a city planner with extensive urban redevelopment experience, commuted to his job with the Boston Redevelopment Authority (BRA), parking his car in the Massachusetts Bay Transportation Authority (MBTA) Kendall Square rapid transit station parking lot. He noticed the area north of the rapid transit station was severely underdeveloped and an urban blight with underutilized, largely vacant and obsolete industrial and warehouse buildings. Because of the extent of urban blight, there did not appear to be any prospects for private development there. As a city planner, he visualized the land as an ideal site for urban redevelopment because of its unique locational advantages, including the rapid transit station, proximity to the Massachusetts Institute of Technology (MIT), direct subway connections to Harvard and downtown Boston, and easy connection to Logan Airport.

Rowland was aware President John F. Kennedy had assigned the task of sending an American astronaut safely to and from the Moon before the end of the decade to the National Aeronautics and Space Administration (NASA) which was searching for a site in the Boston area for development of its Electronic Research Center.

On their own time, Rowland and two associates sketched out a redevelopment plan for the Kendall Square area which would accommodate NASA and provide land for NASA-related private development. He presented his concept plan to the Cambridge Redevelopment Authority (CRA) which asked him to work with the CRA to move the plan through the redevelopment process. Rowland agreed, left his job with the BRA, was hired by the CRA and in 1964 was appointed CRA Executive Director.

In 1964, the CRA presented the concept plan to the Cambridge City Council. The Council voted to have the CRA prepare a redevelopment plan for the Kendall Square area with two objectives: (1) to provide land for both NASA and private development which would generate needed tax revenues for the City of Cambridge and employment opportunities; and (2) to secure maximum federal funds to help alleviate concerns about Cambridge’s ability to finance its share of the cost to carry out the project.

With respect to the first objective, the City of Cambridge, with support from local and congressional representatives, convinced NASA officials of the advantages of a Kendall Square location. After discussions and consultations among the CRA, NASA, Cambridge representatives and the U.S. Department of Housing and Urban Development (HUD), it was determined that development could be expedited by using the urban renewal process.

2. Financing Cambridge’s $6.5-million share of the project cost

With respect to the second objective, the CRA advised Cambridge officials to take advantage of a complex urban renewal financing formula which could be used to "secure maximum federal funds" to finance Cambridge’s share of the cost to carry out the project.. The formula, based on Section 112 of the Housing Act of 1949, provided that expenditures by educational institutions and hospitals on facilities located within a mile of an urban renewal project that contributed to the objectives of the urban renewal project can be used as credits ("Section 112 credits") to cover the local share of the project cost.

The CRA took the lead in coordinating the efforts of Cambridge, MIT officials and congressional representatives to work out the details required to secure federal approval of the Section 112 credits financing plan. The City and MIT entered into an agreement which provided that MIT prepare a Development Plan which included MIT property located within a mile of the redevelopment area to be used for educational purposes. After the City’s review and approval of the plan, the expenditures incurred by MIT to acquire land and construct buildings in accordance with the plan could be used as Section 112 credits. Subsequently, when the Kendall Square Urban Renewal Project was approved, MIT provided $6.5-million dollars in Section 112 credits to cover the City of Cambridge’s entire share of the project cost.

3. NASA Quits. CRA amends Kendall Square redevelopment plan and objectives

The original Kendall Square Urban Renewal Plan covered 43 acres of land and designated 29 acres for use by NASA and 14 acres for NASA-related private development. The initial four years of the project were executed expeditiously. The CRA transferred 19 acres of vacant land to NASA for construction of a 14-story office tower and five low-rise buildings, and prepared an additional 10 acres of vacant land for future development by NASA. In 1970, without warning, NASA decided to abandon its operations in the project. It indicated it did not need the 10-acre site of vacant land designated for its development, and was transferring its interests in the project to the U.S. Department of Transportation (DOT). DOT established the National Transportation System Center on the site formerly occupied by NASA and named it after John A. Volpe, Secretary of DOT and former governor of Massachusetts

Cognizant that the 10-acre site originally designated for NASA’s use under the terms of the original Kendall square Urban Renewal Plan was still undeveloped and in CRA possession, the CRA recognized an opportunity to expand the area of land which could be developed for private uses which would benefit Cambridge more than if the land was developed by the federal government. The CRA decided to amend the Kendall Square Plan to designate new reuses for the undeveloped land even though that meant starting again the complicated and time consuming process of preparing a second Kendall Square Plan.

The CRA commenced negotiations with DOT Secretary Volpe, making the case that DOT should relinquish its rights to Parcel 2 because NASA’s withdrawal from the project was a breach of its contractual obligation with the CRA; a flagrant disregard of its commitment to the community; and had undermined the City’s program to market the project area for private development. After 2 years of prolonged negotiations among the CRA, DOT, U.S. General Services Administration, and HUD, Secretary Volpe released DOT’s rights to Parcel 2 to the CRA.

When NASA decided to withdraw from the Kendall Square area, the feeling in the City of Cambridge was that the project had been delivered a tremendous setback because it had lost its major developer. As it turned out, despite the years of development delays caused by NASA’s the withdrawal, it was a blessing in disguise because the additional 10-acres of land plus the 14 acres already designated for private development became a 24-acre site large enough to create a critical mass for high-tech development in the Kendall Square Project which eventually helped to attract additional high-tech development in the eastern sector of Cambridge.

4. Urban Land Institute Advisory Services engaged to help break planning deadlock.

Cambridge was unprepared for carrying out the difficult and complicated tasks involved in overhauling the original plan and replacing it with an entirely new plan. Cambridge City Council created a task force comprised of representatives from a cross-section of Cambridge organizations and the Cambridge Planning Department to work with the CRA in the re-planning effort. A number of plans were developed, including proposals with contradictory project objectives, including "quick-fix" land uses, such as a beer distribution warehouse, a soccer field, open space, even restoring the Broad Canal, but the City could not arrive at a consensus.

Over time, a cloud descended over the project’s development potential and grumbles concerning the apparent lack of progress in redeveloping the site began to be heard, even mockery about changing the name of Kendall Square to "Nowhere Square".

To help break the planning deadlock, the CRA retained the advisory panel services of the Urban Land Institute (ULI) to review the Kendall Square Project and propose ways to move the project in the right direction. In carrying out the assignment for the CRA, panel members first spent two days reviewing comprehensive briefing materials prepared by the CRA staff and touring the project and surrounding area. Then individual panelists and teams conferred with nearly 100 community spokespersons, citizens, business persons, government officials, members of the local real estate community, and others interested and concerned with the future revitalization of the Kendall Square area.

The ULI panel concluded that only a few properties in the country had a broader array of locational advantages as the Kendall Square area and the opportunities associated with the Kendall Square Urban Renewal Project: "Cambridge Center is a unique opportunity area, one that should be reserved to maximize its locational advantages". The ULI panel presented a point of view that the Kendall Square Project was a valuable asset that has the potential to produce great benefits to the City of Cambridge; and that the CRA and Cambridge City Council should resist the impulse to dispose of the land to take advantage of its short term marketability in response to concerns being expressed about development delays. The panel urged the CRA and City to be patient and adopt an optimal type of development that reflected the highest and best use for the land which would bring the greatest long range benefit to the Cambridge community. The panel proposed a long-term, sophisticated, large-scale, mixed-use optimal type of development.

The ULI panel’s professionalism and diligence in carrying out its mission impressed and gained the confidence of the CRA and Cambridge City Council which endorsed the panel’s recommendations and approved a Kendall Square Urban Renewal Plan for a mixed-use development, with the general objectives of generating tax revenues and jobs.

The ULI panel also warned that attracting developers would not be easy: "Citizen concerns, political pressures, economic uncertainty, and the absence of a united and strong development process have combined to create a credibility problem with the real estate development community". The Panel advised the CRA could overcome developer skepticism about the development climate in Cambridge by establishing a record for getting things done.

The CRA responded by removing all legal and technical impediments to development; completing an Environmental Impact Statement; securing plan and zoning amendments; and carrying out a $7-million public improvements program, including construction of infrastructure and execution of traffic circulation plans.

5. Boston Properties selected to develop Cambridge Center

For marketing purposes the name Cambridge Center was adopted to refer to the 24 acres in the Kendall Square Urban Renewal Project outside of the land occupied by DOT. In 1978, the CRA invited proposals to develop Cambridge Center. Four well qualified developers were selected as finalists, including Boston Properties which was not as well known in the Boston area as the other developers. After exhaustive interviews with each developer and analysis of each development proposal, the CRA designated Boston Properties as developer for Cambridge Center because it had two significant advantages over its competition:

1. Boston Properties’ two principals had worked as a team for many years producing a number of successful well-designed real estate developments nationwide. In contrast, the other finalists had undergone changes or formed new teams, making evaluations of future performance difficult.

2. Boston Properties’ financial capabilities were impressive. It was well capitalized and had a net worth adequate to sustain a large and complex development such as Cambridge Center. It had current assets sufficient to fund first-rate design and site planning; a cash flow arising from a broad, geographically diverse base of real estate investments that could support substantial start-up costs and sustain development during difficult economic times; and a proven ability to manage investment property effectively and efficiently.

Boston Properties turned out to be the right choice because it had the background, experience, resources and patience to attract the type of users that met the standards proposed in the ULI recommendations, that of promoting land development to its highest and best uses. Subsequently, the development of Cambridge Center benefitted the City of Cambridge by achieving goals for the amended Kendall Square Urban Renewal Plan set by the Cambridge City Council: generating $15-million in annual property tax revenues and 7,500 jobs.

6. High-tech development

The combination of (a) the presence of MIT, an international leader in high-tech research and innovation; (b) Polaroid’s decision to locate in Technology Square, a real estate development started in the 1960’s by Cabot, Cabot and Forbes in partnership with MIT that also included Rogers Block, a CRA urban renewal project adjacent to the Kendall Square Project; (c) the presence of Draper Laboratories in the immediate neighborhood; and (d) decisions by the Whitehead Institute and Biogen in 1982 to locate in the Kendall Square Urban Renewal Project area were key elements leading to the emergence of high-tech development in the Kendall Square Project, and helping to attract major technology and biotechnology development in the eastern sector of Cambridge. Today there are over 163 institutional research companies within a 1-mile radius of the Kendall Square Urban Renewal Project area.

5 Western AvenueThe Community Learning Center (CLC) helps adults improve their lives and increase their community participation through free educational programs, tutoring, basic computer instruction. Programs include:

  • Preparation for the GED examinations
  • Preparation for college or a training program
  • Preparation for the U.S. citizenship test

The Cambridge Multi-Service Center (MSC) addresses the needs of homeless and near-homeless individuals and families living in our community. We provide direct services, planning and coordination of efforts for persons who are living on the street, in emergency shelters or at risk of losing their housing.

The Cambridge Housing Authority (CHA) provides more than 5,000 low income families, elders and disabled individuals with affordable apartments or rental assistance.

The CHA fulfills its mission through:

  • The ownership and management of over 2,700 units of housing
  • The administration of over 2,300 Housing Choice vouchers
  • Continued development of affordable units
  • A wide range of tenant services

Coming up at the Cambridge City Council on Monday, June 3

Coming up at City Council on Monday, June 3

During a municipal election year, it is common that the content of City Council Orders is at least in part motivated by the need to identify or, in some cases, create issues that will distinguish the author of the Order. The same can be said of matters taken up by the City Council committees and more. Controversy and alarm are sure to draw more attention than more mundane matters. There’s now just four weeks to go before nomination papers become available for City Council candidates, and it’s a good time to look at the actions of our local elected officials through a campaign-tinted lens. With this in mind, here’s a list of some of the more interesting agenda items on this week’s agenda:

Manager’s Agenda #5. Transmitting communication from Robert W. Healy, City Manager, relative to Awaiting Report Item Number 13-38, regarding a report on measures the City can take to prevent the transport of ethanol. [Meeting Notice with response from Congressman Michael Capuano]

Order #6. That the City Manager is requested to appoint a working group of up to eleven people charged with drafting a community response to the Mar 29, 2013 report issued by the Massachusetts Department of Transportation as it relates to ethanol transport and the impact on the City of Cambridge.   Councillor Maher and Councillor Decker

There’s no doubt that this is a significant issue that deserves a thoughtful response, but it’s true that an atmosphere of fear is something that can be nurtured and exploited for political gain. The state legislature has taken some steps to stop trains bearing this particular hazardous cargo, but the letter from Congressman Capuano makes clear that federal jurisdiction in interstate commerce may trump any such efforts, including actions targeting things other than the transportation of such cargo. It’s not surprising that residents may be fearful, especially with news stories from elsewhere about train derailments and their consequences.

Should this plan go through, the most likely route would follow the Fitchburg Line through North Cambridge and Porter Square and then through Somerville en route to the Chelsea destination. The Grand Junction branch passing through Cambridgeport and East Cambridge is a possible alternate route. Perhaps the most potentially dangerous locations for any route would be at-grade crossings. On the preferred route, this includes Sherman Street in North Cambridge and Park Street in Somerville.

Manager’s Agenda #10. Transmitting communication from Robert W. Healy, City Manager, relative to Awaiting Report Item Number 13-33, regarding a report on adding a RSS feed to all City web pages.

This item will be carefully scrutinized by Councillor Cheung, John Hawkinson and Saul Tannenbaum, but probably not by legions of other residents.

Manager’s Agenda #22. Transmitting communication from Robert W. Healy, City Manager, relative to Awaiting Report Item Number 12-78, regarding a report on expanding the number of parks/playing fields with public toilets; Awaiting Report Item Number 12-132, regarding a report on incorporating permanent bathroom facilities at the Cambridge Common, conducting a study for permanent bathroom facilities in all squares and providing a list of all locations were portable bathroom facilities are currently located; Awaiting Report Item Number 12-150, regarding convening a task force to look into the creation of providing permanent public restrooms at high volume locations; and Awaiting Report Item Number 13-55, regarding a report on efforts to develop a working group to review public bathroom issues.

As the text of the Manager’s report indicates, this responds to four separate Council orders. Though the idea of bathroom facilities may seem like a not-so-hot topic, it has actually brought out a lot of people during the Public Comment period of meetings over a span of quite a few years, and good answers are not so easy to come by. This is also not just about the Cambridge Common. In past years there was a lot of discussion about creating public toilets in the major squares, but nothing really happened for a variety of reasons. Nonetheless, people still "have to go" and you can’t change that via legislation. It does seem clear that the City administration is taking the matter seriously and that some accommodation will follow.

Manager’s Agenda #28. Transmitting communication from Robert W. Healy, City Manager, relative to Awaiting Report Item Number 13-60, regarding a report on the feasibility of donating old computers to non-profit agencies in lieu of recycling them.

This is clearly a good thing, but one has to wonder why sensible efficiencies like this should require City Council orders. The City of Cambridge is often seen as a leader in "sustainability" efforts, and one major part of this involves waste disposal and reuse options. It seems to this writer and long-time recycling advocate that all City departments should be ensuring that surplus equipment is disposed in the best possible way, and reuse certainly seems a better choice than other alternatives.

Unfinished Business #14. Report from Councillor David P. Maher, Chair of the Ordinance Committee, for a public hearing held on Apr 3, 2013 to discuss an amendment to the Zoning Ordinance to create a new Section 6.100 Bicycle Parking, and to create a new definition for Bicycle Parking in Article 2.000, modify the yard standards in Article 5.000 as they relate to bicycle parking and modifying various sections of Article 6.000 to remove references to bicycle parking. The question comes on passing to be ordained on or after May 6, 2013. Planning Board hearing held Mar 19, 2013. Petition expires June 17, 2013. May 6, 2013 substituted language referred to Unfinished Business and remained on Unfinished Business.

I suspect this will be ordained at this meeting. The proposed ordinance could be made better by including a requirement for secure bicycle parking for all redevelopments. At the very least, there should be a requirement that there be no net loss of potential bike parking below an established minimum for both residential and commercial buildings.

The Extension School has been providing affordable educational opportunities for residents for a century and Michael Shinagel served as Dean of the Division of Continuing Education for 38 years from 1975 through 2013. Order #2. That the City Manager is requested to confer with relevant City staff, City of Boston, state transportation officials and Longfellow Bridge construction project managers to determine if it would be possible for pedicabs to transfer passengers from the general MGH/Charles Street area of Boston to the general Kendall Square area of Cambridge and back again.   Councillor Kelley

This is an excellent idea. Still unresolved, however, is the question of where pedicabs should ride on streets where the City wants install so-called "cycle tracks." The pedicabs often consume the entire width of these bike lanes, and in order to accommodate the sidewalk "cycle tracks" roadway widths are often narrowed to the point where motor vehicles and cyclists can no longer safely share a travel lane in the road. It’s even worse for pedicab drivers who will have no option other than to "take the lane" or ride the sidewalk. This conflict will likely not be an issue on the Longfellow Bridge.

Order #5. That the City Manager is requested to confer with the State Auditor’s Office to determine if the state of Massachusetts will fund the costs incurred by the city when it assesses and establishes full and fair cash value for tax-exempt properties within the City of Cambridge even though the city cannot collect taxes from said properties.   Councillor vanBeuzekom

As the Order states, the City cannot collect taxes from said properties, so how the assessment takes place is unimportant to the City. The simplest solution is to simply ask that the owners of tax-exempt properties submit estimates of their "full and fair cash value." There will be no tax collected anyway, so there’s no practical need for more than a good estimate. This also applies to the valuation of City, State, and Federal properties within the city.

Committee Report #4. A communication was received from Donna P. Lopez, Interim City Clerk, transmitting a report from Councillor David P. Maher, Chair of the Government Operations and Rules Committee, for a public meeting held on May 22, 2013 to review the status of positions reporting directly to the City Council.

The purpose of this meeting was to take up the issue of the appointment of the City Clerk and the City Auditor. It’s about time that the word "Interim" should be removed from "Interim City Clerk Donna P. Lopez." Jim Monagle is also expected to be reappointed as City Auditor.

Unfinished Business #10. Transmitting communication from Robert W. Healy, City Manager, relative to Awaiting Report Item Number 12-90, regarding a report on Executive Session to discuss lawsuits. [City Manager Agenda Number Seven of Feb 25, 2013 Placed on Table on motion of Councillor Kelley on Feb 25, 2013.]

Communications & Reports #1. A communication was received from Councillor Craig Kelley notifying the City Manager and City Council of his intention to move to take Calendar Item #10 from the table to enable discussion of various lawsuits against the City.

Communications & Reports #2. A communication was received from Councillor Minka vanBeuzekom alerting her colleagues of her intention to pull Awaiting Report Item Number 12-90 (Unfinished Business #10) to discuss pending lawsuits.

My speculation is that these fundamentally identical communications originated on Brookford Street and that Public Comment will once again feature bitter commentary from one of its residents. City Manager Robert Healy will retire four weeks from today. The City will move on without skipping a beat, but some multiple-decade critics may never move on. – Robert Winters


Addendum: At this meeting the City Council accepted a late committee report from the Government Operations & Rules Committee and passed the following Order:
ORDERED: That the former site of the Cambridge Police Department which is now the new location for the Cambridge Community Learning Center, the Cambridge Housing Authority and the Multi-Service Center be named the “Alice K. Wolf Center” and that a suitable dedication ceremony be planned by the Executive Assistant to the City Council and the staff, and be it further
ORDERED: That the Deputy City Manager be and hereby is requested to report back to the City Council with a plan for either a suitable plaque or a sign for the “Alice K. Wolf Center“.

FY2014 School Department Budget Stalled by City Council

The Cambridge City Council at its FY2014 Budget Hearing on May 9 failed to approve the School Department Budget of $150,989,445 on a 3-4-1-1 vote [YES – Decker, Maher, Davis; NO – Simmons, Kelley, Cheung, vanBeuzekom; PRESENT – Toomey; ABSENT: Reeves]. The budgeted amount represents a 4.1% increase over the previous year and is in line with the increases of other City departments. This should require at least one more meeting of the Finance Committee to take up the FY2014 Budget and, presumably, another meeting of the School Committee to respond to the rejection of its budget. [Update – The Budget was not rejected, but held in the Finance Committee pending the resolution of a variety of questions. It was subsequently discharged on May 20 without any of these questions being addressed.]

Under the Charter, the City Council may reduce any submitted departmental budgets but they may not increase them. On the other hand, requests can be made through the City Manager to adjust and resubmit budgets. Cambridge being Cambridge, it’s likely that the budget rejection is based on a desire to spend MORE money rather than less money. It is the responsibility of the Cambridge School Committee to determine how money is allocated within the School Department budget. The City Council can only vote on the bottom line. If the intention of the City Council is to now involve itself in specific School Department budget items, this represents a radical departure from what is permitted under the Charter and calls into question the role and responsibilities of the School Committee. – RW

Here are the agenda items that seem interesting:

Reconsideration #1. Councillor Maher has notified the City Clerk of his intention to move reconsideration on the vote taken on Apr 22, 2013 to adopt an order for a curb cut at the premises numbered 16 Channing Street.

I hope there was no premature rejoicing by Channing Street neighbors when this was voted last week with two councillors absent. The matter passed on a 4-3-2 vote, so it never achieved a majority of the full City Council. Regardless of the merits of the petition, its disposition should not be determined by the fact that two councillors had to be on Beacon Hill to vote on the State Budget. This deserved a proper vote and Councillor Maher has appropriately filed for Reconsideration.

Last week also saw the introduction of the City’s FY2014 Budget, and the following week’s agenda usually contains a number of Capital Budget orders in order to set the table prior to the annual Budget Hearings (Apr 30 and May 9). Here are this year’s Capital Budget items:

Manager’s Agenda #1. Transmitting communication from Robert W. Healy, City Manager, relative to an order requesting the appropriation and authorization to borrow $2,180,000 to provide funds to supplement other financing sources for improvements to the Cambridge Common.

Manager’s Agenda #2. Transmitting communication from Robert W. Healy, City Manager, relative to an order requesting the appropriation and authorization to borrow $1,000,000 to provide funds for the reconstruction of several streets and sidewalks.

Manager’s Agenda #3. Transmitting communication from Robert W. Healy, City Manager, relative to an order requesting the appropriation and authorization to borrow $54,658,000 to provide funds for construction of sewer separation, stormwater management and combined sewer overflow reduction elimination improvements within the City’s Alewife Watershed, Harvard Square, Agassiz, and Cherry Street/South Massachusetts Avenue areas as well as the Sewer Capital Repairs Program.

Manager’s Agenda #4. Transmitting communication from Robert W. Healy, City Manager, relative to an order requesting the appropriation and authorization to borrow an additional $500,000 to provide funds for improvements to the Kendall Square area including Main Street between Broadway and Ames Street including the reconstruction of streets and sidewalks and the installation of new pedestrian-scale public lighting, street furniture, trees, and other beautification measures.

It’s interesting to view these orders over the years as a measure of the gradual rebuilding of City assets. For example, last year’s Capital Budget orders totaled $17,442,670 for such things as replacement of the roofs on City Hall, and the Ryan Garage and Simard Buildings at Public Works; Kendall Square reconstruction of streets and sidewalks, lighting, street furniture, trees, and other beautification measures; acquisition of a ladder truck and pumper; synthetic field surfaces on the soccer fields at Danehy Park; and a variety of sewer separation and stormwater projects within the City’s Alewife watershed. This year’s appropriations are much greater and are dominated by sewers – things upon which we all depend but will likely never see.

Manager’s Agenda #6. Transmitting communication from Robert W. Healy, City Manager, relative to the appropriation of $40,000 from Free Cash to the General Fund Public Works Other Ordinary Maintenance account appropriation will fund the feasibility study for the Foundry building. Additional, this request is in response to Awaiting Report Item Number 12-87 and 12-105 as well as several other Council Orders related to this matter.

The Foundry Building in East Cambridge came to the City as a result of the Alexandria zoning petition. I have been told that the building has been available for occupancy and sitting vacant as potential revenue is lost and potential occupants have been waiting. Perhaps this appropriation together with some cooperation among city councillors will finally get things moving.

Applications & Petitions #4. A zoning petition has been received from Jenny Popper-Keizer, et al., requesting the City Council amend the Zoning Ordinance and Map from SD-8A to Residence C-1 in the area bounded by Allston Street to the north, Putnam Avenue to the south, Sidney Street to the west and Waverly Street to the east.

This petition is clearly inspired by the proposed housing development at 240 Sidney Street, 40 Allston Street, and 618 Grove Avenue that has already had a public hearing before the Planning Board. There’s an online petition that preceded the zoning petition that reads as follows: "Fulmore Park is the cornerstone of a family neighborhood with about 45 homes surrounding it. Most of these are triple deckers with a couple of two family homes thrown in. The development at 240 Sidney Street aims to build 107 apartment buildings [they meant to say "apartments"] along the eastern edge of the park. The units are studio, one and two bedroom apartments all meant for rental not to create owner-occupied or family friendly homes. This will irreversibly change the character of the neighborhood. ….. Adding more traffic to this street is not in the interest of public safety and should be disallowed. ….. Parking in the on-site garage is rented separately from the apartments. This will create a glut of new residents who choose the much less expensive resident permit rather than renting a spot in the garage of their building. Parking is already congested in the area and will become impossible if this is allowed to pass. Finally the developer has made no attempt to contact abutters to solicit feedback about the project before submitting the plans for approval. We cannot let developers slide by without proper community outreach."

The petition focuses on loss of parking, increased traffic, the somewhat vague "change the character of the neighborhood", and lack of sufficient process. The parking issue is interesting primarily because the developers sought from the Planning Board a reduction in required parking. There has been a curious mixture of actual trends and wishful thinking of late when it comes to the matter of parking for new residential developments. While it’s true that more households are going without cars, it’s a valid concern that when parking is not included in new housing, at least some of the new residents will store their cars on the streets ($25/year permit fee) instead of paying exorbitant fees to park on premises. Honestly, that’s what I would do. The claims of burdensome increases in traffic seem ill-founded. Residential developments generally don’t have major impacts on traffic, especially if many of the residents exhibit similar behavior to other Cambridge residents in walking and biking to work.

The "change the character of the neighborhood" concern is the one I find most interesting. Neighborhoods are more about people than buildings, so it’s a little hard to figure what kind of change is the offense here. Perhaps it’s the potential influx of young professionals (they give me the willies, too), but it’s probably the case that most of the new residents would be much like the people who have been bidding up and buying homes throughout Cambridgeport and the rest of Cambridge for the last decade and more. If that’s the objection, then it’s fair to say that this is not an issue of zoning.

The events of the last two weeks have hit most of us pretty close to home. In addition to the deaths of these four individuals, many have been maimed, including a number of Cambridge residents known to many of us. When the city was effectively shut down during the hunt for the surviving murderer, some people worried that we were in a "police state," but one friend of mine appropriately characterized it as "an act of mass cooperation with law enforcement." I think that captures it perfectly, and I hope that spirit of cooperation continues. This chapter began for me when, after an 8-mile hike with AMC Local Walks, I was under Copley Square when the bombs exploded. This past Saturday I led another AMC hike in the Middlesex Fells, and I’ve chosen to close this horrible chapter on that positive note. I hope we never have to go through anything like this again.

Order #1. That the City Council refer to the Ordinance Committee and the Planning Board, for hearing and report, the proposed changes to the Cambridge Zoning Ordinance relating to rainwater separation in residential buildings.   Councillor Kelley

I’m pretty sure the genesis of this proposal was a request last year from one resident who wanted to replace his flat roof with a pitched roof. Overall, the proposed zoning change contains some interesting ideas and deserves consideration.

Order #4. That the City Manager is requested to instruct the City Solicitor to clarify the expiration date for zoning petitions filed in the City of Cambridge – either 90 days from the date of the first City Planning Board meeting or 90 days from the first City Council Ordinance Committee meeting.   Councillor vanBeuzekom

Let’s just make this simple. There is no need for further clarification. Simply propose a minor zoning amendment to change Section 1.52 of the City’s zoning ordinance to replace "within ninety (90) days after the Planning Board’s hearing" to "within ninety (90) days after the initial Ordinance Committee hearing". That makes the state law and the city ordinance consistent – problem solved.

Order #5. That the City Manager is requested to direct the City Solicitor to clarify whether private driveways and apartment garages may be rented to car owners that are unrelated to the property and by what process can these spaces be legally rented.   Councillor vanBeuzekom

The simple answer is that they generally cannot be rented, but we all know people who do rent them out. It’s one thing to let a friend or neighbor park in your driveway, but it’s a whole ‘nuther matter when you’re essentially running a commercial enterprise by deriving income in this manner. It also violates the City’s Vehicle Trip Reduction Ordinance.

Order #7. That the City Manager is requested to provide to the Cambridge City Council an explanation of how the City of Cambridge Police Department and the FBI work together to collect and share local intelligence information and respond to reports on individuals that are identified as potential terrorists.   Councillor vanBeuzekom

This should receive a fine response from Councillor Decker and the ACLU gang, but it’s a legitimate question and concern. – Robert Winters

Once Upon a Marathon

Green Building at MITApril 16, 2013 – I led an 8-mile AMC Local Walk yesterday from the Forest Hills T station to Heartbreak Hill where we then watched the Marathon runners before heading back into Boston. After a walk from the Boston College area to the Reservoir stop on the Green Line, several of us were packed into a trolley heading toward Park Street. We never arrived. We were approximately under the Copley Square station when the bombs exploded above us. I didn’t hear them, but when we were evacuated at Arlington Street you could tell that something was extremely wrong. When we got out into the street there were emergency vehicles racing from everywhere. At first nobody knew what was happening. When word started to spread that there had been a bombing, it was accompanied by word that it had been a diversion and that other bombings might follow. There was a lot of worry in the faces of most people. Thankfully, no other bombs followed.

Though I was pretty tired after walking perhaps 9 miles already, I had to then hike over to the Charles/MGH station to get back to Cambridge. Near MGH you could see hospital staff running toward MGH as the ambulances were arriving. I was practically the only one not staring into a cell phone or texting messages to people. It was surreal. From Central Square, yet more walking to get home and even in Cambridge you could see and hear the emergency vehicles racing toward Boston and toward suspicious sites in Cambridge. Like everyone else, watching the TV was like watching a horror movie.

Today I’m reading messages from politicians trying to get in air time. Spare me. Like millions of people in this area, I don’t want to hear any more messages from politicians expressing concern. I don’t want to hear about peace vigils or about why we should not give in to fear. Any fear passed quickly for most people. I want only that justice be done. Any person or group of people who would do such a thing should be treated like a disease and removed from the civilized world. Any philosophy or ideology espoused by such people should be damned. – Robert Winters
