Nov 19, 2012 Cambridge City Council Agenda highlights

Here are some items that jump out as worthy of comment:

City Manager’s Agenda #1. Transmitting communication from Robert W. Healy, City Manager, relative to Council Order Number 10, dated 5/23/2011, regarding Biogen return to Cambridge.

Biogen Idec Inc. intends to soon relocate its headquarters to Cambridge where it now has a substantial presence. As the Manager’s letter states, "The remaining outstanding barrier is the zoning requirement that a cafeteria be located on the ground floor of the building and open to the public at least 20 hours per week." This seems like a completely reasonable accommodation, especially if the local business association makes a parallel effort to create affordable food options in the immediate area. Most people would likely choose to eat in a restaurant than in the cafeteria of a life sciences building anyway. Perhaps that existing provision in the zoning code is a vestige of the days when Kendall Square had vanishing dining options. That’s no longer the case, though the provision of affordable dining options could still use some attention.

Resolution #15. Resolution on the death of William M. Hogan, Jr.   Councillor Maher

William Hogan was a former Cambridge City Councillor and first Vice Mayor under the Plan E Charter. He was the last surviving councillor elected in 1941 in Cambridge’s first PR election under the Plan E Charter adopted the previous year. He died at the age of 100. He would have been about 27 when he was elected (in 1939) and 31 when he left office. He ran unsuccessfully for reelection in 1943. He was among the last elected councillors-at-large in 1939 under the previous charter and the first under the new Plan E charter.

Resolution #25. Thanks to City staff for their work on Election Day.   Mayor Davis

Order #16. That the City Manager confer with the Election Commission to make information publicly available on wait times throughout Election Day and the number of booths at each precinct.   Councillor Cheung and Councillor vanBeuzekom

Though I had to wait over 40 minutes in line to vote this year, when I got to the front of the line I saw only efficiency and courtesy from the the poll workers at the City Hall Annex. Though things may have run faster with more booths, the real slowdown was caused by the presence of several additional nonbinding ballot questions that most people did not have an opportunity to read prior to voting. If it were my call, I would allow voters the option to vote outside of the booths if they don’t mind doing so. The checking in, checking out, and inserting of ballots into the scanner go very quickly. The limiting factor is the number of booths. One of the great advantages of scannable paper ballots is that there is no strict limit on how many voters can simultaneously if there is some flexibility in where you can fill out your ballot. Mayor Davis’ appreciation of election workers stands in marked contrast to the recent bellyaching of one of her colleagues.

Order #1. That the City Manager is requested to investigate creating a pilot program for installing mini exercise stations on major walking routes throughout the city, perhaps at bus stops, subway stations and public parks.   Mayor Davis

Order #2. That the City Manager is requested to look into the installation of public drinking fountains at additional locations in the city – possibly working with the Cambridge Arts Council on interesting designs.   Mayor Davis

These are interesting and creative suggestions. Every such installation, however, will have to be maintained and that could be problematic. I’m inclined to believe that public parks and plazas would be a lot more appropriate than bus stops and subway stations.

Order #4. That the Cambridge City Council go on record urging the members of the Senate Ways and Means Committee to pass MA Senate Bill 2314, "An Act Relative to Plastic Bag Reduction."   Councillor vanBeuzekom

Order #10. That the City Manager is requested to instruct the Law Department to prepare language for an amendment to the Municipal Code to ban the use of polystyrene-based disposable food containers and to provide a waiver provision similar to the by-law of the Town of Brookline.   Councillor Cheung and Mayor Davis

I’m glad that there is attention being given to some of these more annoying aspects of waste management, especially the reduction of materials for which there are limited recycling options. It should be noted that consumers have always been able to avoid plastic bags simply by providing their own reusable bags when shopping. Regarding the banning of polystyrene food containers, don’t be surprised if some food vendors replace them by even more wasteful containers made of other plastics that rarely make it into the recycling stream.

Order #5. That the City Manager is requested to work with the appropriate city officials to explore the possibility of completing and submitting the Bicycle Friendly Community application by Feb 26, 2013 so that the City of Cambridge may be included in the next review cycle and join together with other communities in participating in the Bicycle Friendly Community program.   Councillor vanBeuzekom

As a daily cyclist, I continue to scrutinize the City’s decisions regarding safe accommodation for cyclists and transportation policies that often seem more rooted in hostility toward motor vehicle operators than in the promotion of good alternatives. The City does seem to be doing a better job in their design of on-street bike lanes, though they routinely err in their treatment of these lanes at intersections. State law requires that right-turning vehicles move as far right as possible before making their turn, yet the City often stripes bike lanes with a solid line right up to intersections. Unless a motor vehicle operator drives in the bike lane immediately before turning, there will be a greater risk of turning into a cyclist passing on the right – and many cyclists are oblivious to this danger. The City is also installing "cycle tracks" on some streets that will create significant conflicts at driveways and intersections and will most likely narrow travel lanes to the point where on-street cyclists wishing to maintain more than casual recreational speeds are endangered. I don’t expect these realities to be reflected in the City’s application, and City planners have been unresponsive in their cycle track juggernaut.

Order #9. Special Permit process pursuant to MGL 40A as it relates to the impact of re-filing a zoning petition on pending special permits or special permits that have been granted.   Councillor Kelley

Though I won’t speak to the merits of this Order, the confusion by city councillors over the recent "move to withdraw" the Yanow Petition indicated that a little more schooling on zoning regulations and procedures may be in order.

Order #11. That the Cambridge City Council go on record urging the members of the Massachusetts Committee on House Steering, Policy and Scheduling to pass MA House Bill 4165, "An Act Relative to Speed Limits."   Councillor vanBeuzekom

This legislation would reduce the speed limit within "thickly settled areas" and business districts from the current level of 30 miles per hour to 25 miles per hour. As a "thickly settled area", all of Cambridge would likely be covered by this reduced speed limit. While this would make sense in many Cambridge locations, especially on narrow streets with many parked cars, there are plenty of other streets where the existing 30mph speed limit makes more sense. This proposal is introduced every few years and is usually not supported by transportation engineers who argue that, in the absence of other factors, speed limits should be set according to prevailing speeds in order to minimize conflicts.

Order #20. That the City Manager is requested to confer with the appropriate city officials to explore the possibility of communicating appropriate storm preparedness through the website and text messages sent by the city.   Councillor vanBeuzekom

This is a good suggestion and consistent with the City’s long-standing practice of encouraging residents to help keep storm drains clear during and after winter storms. Having braved Sandy’s wrath on several occasions to clear the storm drains in my neighborhood, I think it would be very helpful if people were more aware of keeping these drains unobstructed. That means not only parking clear of the drains, but also picking up a rake and getting out there to help keep the drains clear.

Committee Report #1. A communication was received from Donna P. Lopez, Interim City Clerk, transmitting a report from Councillor David P. Maher, Chair of the Government Operations and Rules Committee, for a public meeting held on Oct 19, 2012 to discuss Community Benefits.

The report suggests that the City Council has a long way to go before really coming to terms with this issue. In simple terms, a community benefit is the money paid or benefit provided by a developer for up-zoning property. However, when city councillors are closely involved in deciding how these funds should be spent, the funds often go toward pet projects or priorities of individual councillors. The default option is often affordable housing. One of the more refreshing aspects of the Goody Clancy process for Kendall Square and Central Square has been the expanded definition of community benefits to include things like the exclusion of ground floor retail in the calculation of building densities, financial support for retail in the form of either reduced rent or outfitting the space, and the creation of public spaces for markets and other purposes. These and other ideas are welcome additions to the discussion of what community benefits might flow from permitting additional density in appropriate locations. This committee report only refers to housing and human services, and that’s far too limiting. The Government Operations Committee and Ordinance Committee would be well-advised to absorb the forthcoming recommendations regarding Kendall Square and Central Square before redefining what constitute community benefits and how any related funds should be disbursed. It should also be stated that when community benefits are tied to up-zoning proposals, there is the very real possibility that every such proposal will be granted as long as enough cash is put on the table – regardless if the proposal makes good planning sense. – Robert Winters

City Council to discuss last December’s fatal bicycle crash

On Monday, July 30, 2012, the Cambridge City Council is to discuss a City Manager’s report on the December, 2011 fatal truck/bicycle crash at Vassar Street and Massachusetts Avenue. (I commented on that crash in an earlier post in this Forum).

The city has posted the agenda of the meeting. The City Manager’s report on the crash is on that agenda.

I’ve posted that report here — indented, with my comments unindented:

To the [City Council]:

In response to Awaiting Report Item Number 12-63 relative to a report on safety issues at the intersection of Massachusetts Avenue and Vasser [sic] Street, Director of Traffic, Parking and Transportation Susan E. Clippinger reports the following:

In response to the fatal bicycle crash on December 27, 2011, the Traffic, Parking + Transportation Department conducted a review of the intersection that included the operation of the traffic signal, signs and pavement markings of the intersection, and a review of the crash history of the location.

Using both the Massachusetts Department of Transportation and Cambridge Police Department crash information, TP+T reviewed 19 incidents involving bicycles which occurred in the 5 years between 2007 and 2011 (excluding the fatality which was under investigation). The purpose of the review was to determine if a common type of crash was frequently occurring and if engineering measures could be implemented to prevent future crashes.

A Policy Order Resolution from the May 14 City Council meeting (third page here) describes Vassar Street and Massachusetts Avenue as the second-worst intersection for crashes in the city, and reports 55 crashes, with 24 involving “cars” (which I take to mean all motor vehicles). Clippinger reported on 19 bicycle-motor vehicle crashes over a 5-year period — however, single-bicycle, bicycle-bicycle and bicycle-pedestrian crashes are just as real. Perhaps Clippinger did not report on 5 of the bicycle-motor vehicle crashes because evidence was too sparse, but on the other hand, what about the remaining 31? All 55 crashes were serious enough that police reports were filed. Also, bicycle crashes of all kinds, especially those not involving motor vehicles, are greatly under-reported to police.

A couple years ago in a national Webinar, the City’s bicycle coordinator, Cara Seiderman, said that there had been no crashes on the Vassar Street sidepaths. Evidently, she excluded intersections, and even so, her statement was incorrect. There had been at least two bicycle-pedestrian crashes on the sidepaths in which someone was taken away in an ambulance. Following each of these crashes, one of the parties e-mailed me, having read my online comments about the sidepaths. There have almost certainly been additional crashes.

Clippinger’s report continues:

We found that in 17 of the 19 crashes, the bicycle was proceeding through the intersection and was not turning left or right. In eight of the 19 crashes, the vehicle was turning right. A common cause of this type of crash is that either the driver fails to yield upon turning or the bicycle is traveling too fast to stop in time for a vehicle that is in the process of turning.

Clippinger places the responsibility on the motorist to look to the right rear to yield to bicyclists who are foolishly overtaking on the right. Bike lanes to the right of right-turning traffic at intersections, as here, encourage bicyclists to make this mistake.

It also appears that most of these crashes were minor; only two crashes resulted in the cyclist’s being transported to the hospital.

17 of the 19 cyclists described in the report evidently were lucky. Such “coffin corner” crashes are often fatal when the right-turning vehicle is a large truck or bus. However, Clippinger doesn’t report how serious any of the injuries were, whether or not the cyclists were transported to the hospital. To be fair, she may not have had access to this information. It’s hard to get.

Based on the limited information we have on the location and direction of the cyclist involved in the December 27 crash, TP+T determined that this crash is not consistent with the crashes experienced previously at this location. Further, we determined that the traffic signal operation, signs, pavement markings, and layout of the intersection did not contribute to this crash.

I agree that this was a different type of crash. However, features of the intersection almost certainly contributed to the crash. As I noted in my review of the Tech article — and as reported by eyewitnesses — the right turn was difficult for the trucker because of a bulbout and street furniture on the corner. It is likely that the driver was looking into his right side-view mirror to make sure that the truck cleared the street furniture, and so failed to see the bcyclist. To clear the street furniture, the truck crossed the centerline on Vassar Street, placing it in head-on conflict with traffic in the oncoming left-turn lane, one of the possible locations of the cyclist. The layout of the intersection had nothing to do with this?

However, I think that the cyclist most likely was crossing in front of the truck from right to left. In that case, he had been riding wrong-way on the Vassar Street sidepath, and then turned to his right across the street. The sidepath and connecting bike lane enable this conduct. He could have been looking to the right for traffic, and failed to notice the truck on his left. Also, his brakes may have functioned poorly in the wet.

Clippinger concludes:

TP+T remains fully committed to improving the safety of our roads for all users, particularly for pedestrians and bicycles. We continue to research causes of crashes citywide, and each year we use that information to make engineering improvements we feel will reduce the number and severity of crashes.

“We feel”. I’d prefer a stronger report, examining all types of crashes, and a bicycle program guided by careful research rather than feelings.

On the Agenda – Highlights of the June 11, 2012 Cambridge City Council meeting

There are several substantial items on the agenda this week. Among them:

City Manager’s Agenda #1. Transmitting communication from Robert W. Healy, City Manager, relative to Awaiting Report Item Number 12-33, regarding a report on a plan for implementing separate trash or recycling curbside pickup for small businesses along existing curbside pickup routes. ["Please be advised that I am not recommending the implementation of such a program given the cost impacts to the City."]

This responds to an Order that grew, at least in part, out of East Cambridge traffic congestion problems caused by multiple collection vehicles. Needless to say, the suggestion that the City should take over all collection did not resonate with these multiple waste haulers. The real deal-breaker is the very substantial additional cost.

City Manager’s Agenda #28. Transmitting communication from Robert W. Healy, City Manager, relative to the purchase of 53.6 acres of watershed land in Lincoln, MA, for $1,152,247 from Community Preservation Act Open Space Reserve Fund, for the purposes of drinking water supply protection and land conservation.

This watershed land is located on the north side of Route 2 in Lincoln just east of Bedford Road. The City has in recent years acquired numerous parcels through which the Hobbs Brook flows en route to the Cambridge Reservoir (Hobbs Basin) in the vicinity of Route 2 and Route 128. Some may argue that Community Preservation Act open space funds should be spent exclusively within the city limits, but watershed protection is generally a very good investment.

Order #1. That the City Manager is requested to confer with the Cambridge Police Commissioner, the Superintendent of Schools, and other appropriate personnel to organize a youth-focused community forum to discuss issues related to the shooting at Willow Street on June 3, 2012, to allow our young people a chance to openly communicate their concerns, grievances, and ideas directly with City officials and administrators.   Vice Mayor Simmons

Order #2. That the City Manager is requested to confer with the Cambridge Police Commissioner and to urge him to reach out to the various stake holders in the community, including building managers, property owners, and local business owners, in an attempt to proactively address the summer violence before it has a chance to begin.   Vice Mayor Simmons

Though the law enforcement aspects of the shooting near Donnelly Field are appropriately in the hands of the Cambridge Police and the District Attorney, it is appropriate that Vice Mayor Denise Simmons should take a leadership role in the many other necessary responses to this incident that hit uncomfortably close to home. The greatest opportunity for leadership lies among the young people who know the victims and who may be able to help in the resolution of the case and in the prevention of future violence.

Order #4. That a Task Force be formed to review Cambridge’s current program to creatively encourage and maximize participation in PILOT agreements with the City, and to evaluate the possibilities of implementing SILOT (Services In Lieu of Payment) and/or GILOT (Grants In Lieu of Payment) programs.   Councillor vanBeuzekom and Councillor Cheung

The motivation of this Order appears to be a comparable program by the City of Boston that has achieved some success in generating addition revenue from tax-exempt institutions. Though the prospects are not great for additional payments in lieu of taxes, there is clearly plenty of opportunity for non-profit and educational institutions to offer services in lieu of taxes. The major colleges already provide many such services and could probably do more with some facilitation.

Order #6. That the City Manager is requested to confer with relevant City and Harvard staff to determine who is doing what on the Cambridge Street Overpass, how through passage is being safely managed, how signage has been displayed, what the overall plans for this project are and the timing of the work and its expected completion date.   Councillor Kelley

There was a very comprehensive presentation about this made at a recent meeting of the Mid-Cambridge Neighborhood Association. Though substantial work is planned, the disruption both to the tunnel and the plaza above should be acceptable. The redesigned plaza will no longer have its familar grassy areas, but it will have the potential to become an important new public space for both Harvard and the City. [Details on the project (DPW) – Check out all the tabs.] I just hope the Harvard planners have an alternative for driving stakes into the ground when they want to install a tent. It’s not so easy to drive stakes into concreate pavers.

Order #7. That the City Manager is requested to report back to the City Council with an explanation of how the City plans to maintain grade separated bikeways and keep them as free from sand, branches and other debris as the adjacent streets.   Councillor Kelley

The larger issue is the grade-separated facilties themselves. While City officials and the public continually frown upon bicycling on sidewalks, they are simultaneously designing it into the Western Avenue project commencing later this year. To those of us who choose to ride in the street with all other vehicles, the City proposal will be less safe for us and slower for the cyclists who use the sidewalk track. It is very unlikely that the sidewalk track will be kept free of snow and ice in the winter. [“Cycle track”: a sidewalk by another name]

Order #8. That the City Manager is requested to report back to the City Council with an explanation of how the locations for the three bike corrals currently in place in Cambridge were determined.   Councillor Kelley

Good question. One of these corrals appeared recently in front of the Broadway Bicycle School. It’s empty basically all the time. [Correction: On Monday there were 8 bikes locked up there, probably related to the City Hall Annex.] Cyclists coming to the Broadway Bicycle School generally bring their bikes inside to work on them. Meanwhile in places all over Cambridge there are derelict bikes chained up for months at a time taking up many of the available locations for locking up a bike.

Order #14. That the City Manager confer with the appropriate departments to discuss the potential of installing security cameras in the Donnelly Field area and report back to the City Council.   Councillor Toomey

The recent shooting at Donnelly Field does not in and of itself justify the installation of such cameras, but their presence could very well have resolved this case in short order. Though the government conspiracy theorists may feel otherwise, their arguments against these cameras remain weak. Public spaces are public and cameras strategically located along roads and on public buildings can and do help in solving crimes.

Committee Report #1. A communication was received from Donna P. Lopez, Interim City Clerk, transmitting a report from Councillor David P. Maher, Chair of the Ordinance Committee, for a public hearing held on May 15, 2012 to discuss the petition of Forest City/MIT to amend the Zoning Ordinances by extending the Cambridgeport Revitalization Development District from Green Street out to Massachusetts Avenue in the area adjacent to Blanche Street and further to provide for the potential development of a residential building on Sidney Street between Massachusetts Avenue and Green Street.

A few thoughts on this (more to follow in the coming weeks as the various advisory committees complete their efforts):

Though the proposal for the All-Asia block is similar to what MIT/Forest City proposed last year, the proposal for a 165-foot residential tower next to the Lafayette Square fire house apparently came out of the Community Development Department. Forest City was receptive to the idea, but it wasn’t their idea. A more human-scale residential building next to the firehouse might be more acceptable as long as an equivalent amount of open space is relocated to a site people would actually use. MIT/Forest City’s primary motivation is the development of the All-Asia block – something they would have done 20 years ago if they had sufficient control of the property. Significant height (about 140 ft.) and density is also proposed there. Of great concern to some MIT faculty is the current trend of MIT sacrificing properties close to the core campus to private development (e.g., Pfizer, Novartis) that might otherwise have supported the academic mission of the Institute.

I would caution people against taking an either-or view of this or any of the other proposals that will soon appear for future development in the greater Central Square area. Some will be opposed to any additional height or density and others will be receptive to any and all additional height or density. I find both of these points of view to be lacking. Surely there is room for people to express their own "vision" for what they want the future of Central Square to be – as opposed to simply reacting to the proposals of others. It’s ironic that the City Council has a Neighborhood & Long-term Planning Committee, yet two things the committee apparently doesn’t do are neighborhood and long-term planning.

I would much rather see the emphasis be on increasing density within the envelope currently prescribed by the zoning code with some strategic modification to induce good uses. The zoning is actually pretty generous already and there are many underbuilt sites in the area – including the All-Asia block. My "vision" for Central Square primarily consists of replacing the one-story and two-story "taxpayer" buildings with buildings that rise 3 to 5 stories at Mass. Ave. and possibly step back an additional story or two. I feel that a good-looking ten-story building like the Central Square Building at Mass. Ave. and Western Ave. should be the (anomalous) upper limit for height. I might be convinced that one other such building should be built, but this should not be the norm. Central Square is not Kendall Square, and it should not be redeveloped in the manner of Kendall Square. The Central Square neighborhood is already somewhat dense and can afford to be more dense if the gaps along Mass. Ave. are better developed and if some of the back lots see new construction. If housing in new buildings close to work is what is needed, I would suggest that the best place for new housing would be in Kendall Square, in the area between Main Street and Mass. Ave. replacing some of the old industrial properties, and on some (not all) of the parking lots.

Regarding the issue of shadows cast by taller buildings, I’ve always felt this to be primarily a naysayer strategy transparently intended to block a given proposal. In Jill Brown-Rhone Park (Lafayette Square), the City has installed umbrellas in that area because of the excess sunniness. I would prefer to see a shorter building than the 165 foot tower currently proposed, but I don’t really care about the shadows. I simply prefer a more human scale in an area that is primarily oriented toward neighborhood people rather than trans-national industries. We have Kendall Square and downtown Boston for that sort of thing.

Committee Report #2. A communication was received from Donna P. Lopez, Interim City Clerk, transmitting a report from Councillor David P. Maher, Chair of the Ordinance Committee, for a public hearing held on May 23, 2012 to discuss a petition to amend the Zoning Ordinances of the City of Cambridge by adding to Section 5.50 entitled "Special Dimensional Regulations" a section 5.54 entitled "Special Regulations for Municipal Elementary and Middle (K-8) Schools.

This is largely a formality despite some of the scary and dishonest e-mail alerts distributed by some activists with nothing better to do than spread false rumors about unlimited heights, unlimited parking, exemption from all zoning, and the consolidation of all middle school programs into a single "supersized" building. False, false, false, and false. – Robert Winters

Reports on December, 2011 fatal truck/bicycle collision

(Note: this post has been updated since first placed online, because readers have asked for images to clarify the location and details of the incident. Also see comments following this post. Review of the reports, images and comments has led to some changes in the post, as well.)


The MIT student newspaper, The Tech, has obtained and posted copies of some of the police reports on the truck-bicycle crash on Dec. 27, 2011 which resulted in the death of an MIT graduate, Phyo Kyaw, ’10. I comment here on the Tech story about the crash, and the police reports it links to.

I study bicycle crashes — it’s part of what I do in my profession, but I offer the following comments for free as, I hope, some small service to the MIT community and to the public at large. [Disclaimer, if needed: I am an MIT alumnus. That is, to some extent, why I take the trouble to write this.]

To sum up what I’m about to say, there’s enough blame to go around. Also, the crash investigation failed to look into a number of significant issues or to frame the legal issues accurately. It shows considerable bias toward the truck driver. The Tech‘s reporting missed on a few points. Specifics follow.

Now we add Kyaw on his bicycle. He may have been traveling toward Massachusetts Avenue on Vassar Street and stuck the truck head-on, as shown by the arrow coming down diagonally from the upper left in the image below — or traveling toward MIT on the sidewalk of Massachusetts Avenue, as indicated by the arrow at the lower left — or crossing the street from MIT, but not in the crosswalk, as indicated by the arrow pointing straight down from the top. The semitrailer truck crossed the centerline of Vassar Street as it turned. The crash occurred at night, in the rain.

Update: surveillance video excludes Kyaw’s approaching on the sidewalk of Massachusetts Avenue. Damage to the bicycle confirms that it was struck on its left side. Kyaw most probably then was traveling westbound in the eastbound bike lane on Vassar Street and cut across the street in front of the truck.

As also described in the Massachusetts State Police accident reconstruction report, the bicycle contacted the truck’s front bumper and came to rest under the dual tandem left rear wheels of the cab. It evidently was dragged quite a distance farther than Kyaw. The report indicates that Kyaw was not riding in the bicycle lane on Vassar Street (also assuming that he was traveling head-on toward the truck) — but does not indicate that the truck had crossed the centerline of that street. There is similar bias later in the report. As described in The Tech:

“The possible cause of this collision was the encroachment of the bicycle into the path of the turning tractor trailer unit,” the [Massachusetts State Police vehicle accident examination] report [page 6] said.

Encroachment of the bicyclist into the path of the truck when the bicyclist was described as on the right side of the street and the truck partially on the left side? Encroachment means that a vehicle is where it isn’t supposed to be. The bicyclist was encroaching, then?

Different considerations apply if Kyaw was not approaching the truck head-on; I’ll discuss them later.

The reconstruction report goes on to say that

…roadway design and engineering did not precipitate or contribute to this collision.

Nonsense. Though they are not mentioned in any of the reports, a bulbout and street furniture on the corner made the turn difficult for the truck, forcing it across the centerline of Vassar street. The truck driver may have been looking in his right rear side-view mirror to make sure that the rear of the trailer cleared the obstacles.

The Tech goes on to say:

Kyaw’s bicycle’s final position was not in a bicycle lane, the report said. Local laws do not require bicycles to travel in the bicycle lane, and it is common for left-turning bicycles to travel in Vassar’s left lane.

The observation about the law is correct other than that it’s state law, but the last part of the quote is incorrect and misleading. Assuming that Kyaw was traveling along Vassar Street toward the truck, he was in the left-turn lane. Bicyclists must merge out of the bike lane to go straight or turn left without conflict with through and right-turning traffic, or with traffic stopped at the curb. I happen to have a Web page with photos of this very intersection illustrating that point.

Again, however, Kyaw may not have been traveling head-on toward the truck. Then the bike lane is irrelevant, because he then would have been crossing the street, and it is impossible to cross the street while remaining in a bike lane.

The Tech also stated that

The reconstruction report cited contributing factors of “moderate to heavy rainfall,” Kyaw’s nonreflective clothing, Kyaw’s presumed high speed, and the lack of a front light on the bicycle.

A headlight is required by law. The lack of a headlight makes sense as a contributing factor, assuming that the truck driver was looking in Kyaw’s direction, placing some of the responsibility for the crash on Kyaw. Reflective clothing is not required by law. A reflector or reflective material only works if headlights are aimed at it. Rain also may have affected Kyaw’s ability to see. Eyeglasses were found at the scene, and when beaded with rain, they spread glare. Kyaw, like the truck driver, may not have been looking ahead. To merge toward the center of the street, Kyaw should have looked back over his shoulder for overtaking traffic.

The Tech continues:

Kyaw was wearing a helmet at the time of the accident, Cambridge Police report #5 said. The bicycle was “not equipped with a front-facing light,” and its front white reflector was partially obstructed by brake and shifter cables, the report said. Massachusetts law requires bicycles to have a front light at night.

Cables obstructing a reflector don’t seem a likely explanation. They’re too narrow unless the reflector is very small. How the position of the cables could be determined from a bicycle that had gone under a truck also isn’t at all clear. The reflector may, however, have been obstructed by Kyaw’s hand, or its reflective properties compromised by dirt or beads of rainwater. The truck’s headlights were in any case not aimed at Kyaw to light up the reflector as the truck rounded the corner. A large truck’s cab is so high above the headlights that a bicycle’s reflectors barely work if the bicycle is close, see explanation here. A vehicle ahead of Kyaw, or car headlight glare behind him, made worse by a wet or fogged windshield on the truck, may have concealed him.

And, again, if Kyaw was not headed toward the truck head-on, the front reflector is irrelevant.

Kyaw’s 21-speed bicycle appeared to be set at the gear combination that was as hard to pedal in as possible, indicating travel “at a fairly fast pace,” police report #5 said. On the other hand, if Kyaw was intending to turn left and was approaching a red light, it is also possible he was slowing down, or had even come to a stop.

The fifth Cambridge police report includes this statement but also indicates that the shifter for the rear derailleur was in the second-highest position, not the highest.

The discussion of Kyaw’s speed would have benefited from interviews with people who knew his riding style, if they could be found. There are many bicyclists who ride in high gear at a low cadence. On the other hand, he might have been strong and fast, yet still foolish enough to ride at night without a headlight. In this case, he would have been heading into an intersection with a major street against a red light at high speed. I consider that unlikely.

Still, all this brings up the issue of educating bicyclists. I’ve advocated for decades that institutions of higher education provide bicycling instruction to incoming students. Avoiding death or brain injury to even one student every couple of years would more than pay for this. Think of the wasted educational investment, and the loss of future alumni contributions. But I digress.

According to Cambridge Police Report #1, the truck driver “stated that he was traveling westbound on Mass. Ave. when he attempted to take a right turn onto Vassar St. [The driver] said that the light was green and his right directional light was on. Moments later, [he] said he felt the impact of something hitting his truck. He stopped and got out of his truck to investigate and observed that he had been in a collision with a bicycle.

This doesn’t indicate which way the driver was looking — not a very informative statement from him. Did the police ask?

According to the reconstruction report, MIT provided video that showed the truck did activate its right directional signal.

(As indicated in a comment with the article, the video did not show Vassar Street, so it didn’t show Kyaw’s approach).

The police reports say little about the condition of the truck other than that its brakes worked. Was its windshield clean? Were all the mirrors in good working order? Were the headlights aligned? Was the driver’s view ahead obstructed? Etc.

The Massachusetts State Police accident reconstruction report says almost nothing about the bicycle, but page 2 of the fifth Cambridge report describes the locations of scrapes and other damage to the bicycle. These are consistent with the truck’s striking the left side of the bicycle and dragging it on its right side. The front fork was bent to the right, suggesting that the bicycle was struck from the left — except that the front fork and wheel were crushed under the wheels at the rear of the truck’s cab. as shown in the still below from a television news report. I have labeled the locations of the bicycle — the saddle is facing the camera; of a shoe; and of where Kyaw lay following the crash. He had been removed by the time the video was shot.

The reports are incomplete in describing the bicycle. Of most importance, what was the condition of the bicycle’s brakes? Even when a bicycle has been damaged by going under a truck, it is possible to examine brake shoe and rim wear, and to determine whether a brake cable had frayed and parted. It is often possible to operate the brakes and determine whether they were in good adjustment.

The bicycle was an under $200 model sold through big-box stores, which are notorious for poor assembly of bicycles — here is the best description of it I could find online. It does have aluminum rims, which brake much better than steel rims in the wet, but how well was the bicycle maintained, and were the brakes working properly at the time of the crash? The police reports say nothing about this.

Though the Massachusetts State Police accident reconstruction report and vehicle inspection report really ought to be definitive on the topics they are supposed to cover, police reports which have not yet been released may possibly fill in some of the missing information.

This week’s meeting is in many ways the set-up meeting preceding next week’s meeting at which the FY2013 Budget will be approved. There are 5 loan authorization orders On the Table totaling $17,442,670 to cover various public works projects that will be voted this week to get all the ducks in a row. Beyond this, it’s all miscellany.

Order #3. That the Mayor is requested to confer with relevant City staff and City Councillors and report back to the City Council on the status of the process for filling the City Manager and City Clerk positions.   Councillor Kelley

Orders like this one make me laugh. Councillor Kelley is the house obstructionist who always votes in the most contrary way in all matters relating to the City Manager. This has earned him the privilege of playing no role whatsoever in the eventual selection of the next city manager (he may have company). If any other councillor offers a substitute order, it will likely eclipse Kelley’s order – even if the substitution is just a punctuation change. In matters of consequence, especially in matters such as this, I would expect the process to be begin with an Order from any of 6 councillors – a list that does not include Councillor Kelley.

Order #10. That the City Manager is requested to confer with the Cambridge Conservation Commission to provide an explanation of how the waiting lists for community garden plots work.   Councillor Cheung

This reminds me of the thoroughly unenlightened mandate laid down several years ago by the Community Development Department regarding the assignment of plots in community gardens. Rather than maintaining an organic mix of new gardeners and long-time gardeners, they proposed evicting any gardener who had tilled their plot for more than three years. It was disappointing to have the Community Development Department ripping the community out of community gardening. In contrast, the Conservation Commission staff generally kept a more balanced approach and I hope this is still the case. The best community gardens in Cambridge are generally the ones in which the gardeners manage their own affairs with adequate City support and minimal intrusion. They have always encouraged sufficient turnover for new gardeners.

Order #11. That the City Manager is requested work with the Traffic, Parking and Transportation Department and report back on a proposed plan of action to improve safety in area of Massachusetts Avenue and Vassar Street.   Councillor Cheung

I pass by this intersection often and the white bicycle marking where Phyo Kyaw was killed in late December is a chilling reminder of how suddenly a life can end. There are rumors circulating about the circumstances of that death, but the matter is now with the District Attorney and details are hard to come by. The intersection is rated as one of the city’s most dangerous, but this is as much a function of the volume of traffic – motor vehicle, bicycle, and pedestrian – as it is about any design flaw. Indeed, it’s just an ordinary intersection of two roads. It would be interesting to see a comparison between the frequency of accidents before and after the City "improved" Vassar Street with its absurd "cycle track" design and narrowing of the roadway. For those of us who bicycle in the road rather than on the sidewalk, that was no improvement. The City is planning to "improve" Western Avenue in a similar manner beginning later this year. – Robert Winters

Now Featured on the Dec 12, 2011 Cambridge City Council Agenda

The agenda is short but potentially interesting. Here are a few items worthy of a comment or two:

Manager’s Agenda #8. Transmitting communication from Robert W. Healy, City Manager, relative to the appropriation of $100,000 to the Community Development Public Investment Fund Extraordinary Expenditures account which will be used to pay for design consultant services for a proposed bicycle & pedestrian path along the former NECCO railroad spur in Cambridgeport.

This is personal highlight in that I recall making the initial suggestion for this at a meeting of the Central Square Advisory Committee when Novartis first presented its plans to occupy the old NECCO candy factory. The old RR line once brought in trainloads of sugar to the NECCO plant.

Manager’s Agenda #9. Transmitting communication from Robert W. Healy, City Manager, relative to four appropriations totaling $1,204,701 to the Community Development Public Investment Fund Extraordinary Expenditures account. These appropriations will be used to pay for the purchase of and a three year maintenance contract for Hubway bike share stations, holding 220 bikes at 22 stations located in the densest areas of the City. [The total of this appropriation is derived from the following sources: Metropolitan Area Planning Council through funds received by a Federal Transit Administration Grant ($630,640); Massachusetts Department of Transportation through funds received by a Federal Congestion Mitigation Air Quality Grant ($274,061); Harvard University ($200,000) and; Massachusetts Institute of Technology ($100,000). The Hubway Bike Share system is expected to be launched in the spring of 2012 and will operate approximately nine months per year and be removed during winter months.]

On balance, the availability of the Hubway bikes in Cambridge is a nice added convenience for those who choose not to use their own bicycles for short-trip transportation. One potential advantage I see is less worry about bicycle theft (presumably most of that liability will fall to Hubway). There are still some awkward details to be worked out about the location of the Hubway stations. For example, there have been some concerns expressed by people who work at the City Hall Annex (344 Broadway) that some of the landscaping would be removed to accommodate the bikes. Alternately, on-street parking spaces could be removed. In any case, convenience does have its costs.

Unfinished Business #10. A communication was received from D. Margaret Drury, City Clerk, transmitting a report from Councillor Sam Seidel, Chair of the Ordinance Committee for a public hearing held on Sept 14, 2011 and a follow-up public meeting on Oct 25, 2011 to consider a re-filed petition to amend the zoning ordinance filed by Chestnut Hill Realty. The petition would allow creation by special permit of rental apartment units in basement units of existing multifamily residential buildings in Residence C Districts which meet the special permit criteria. The question comes on passing to be ordained on or after Nov 28, 2011. Planning Board hearing held Sept 6, 2011. Petition expires Dec 13, 2011.

Communications #3. A communication was received from Heather Maguire Hoffman, Co-President, Association of Cambridge Neighborhoods, regarding the Chestnut Hill Realty petition.

As has been stated repeatedly here, this is The Petition That Will Not Die – twice disapproved by the Planning Board with numerous questions raised by the City Engineer, and accompanied by gobs of cash directed to the campaign accounts of several city councillors. It’s actually quite telling that there is such activity to approve some variant of this petition before its Dec 13 expiration. Squeezing in basement apartments (legal or otherwise) to make some extra cash has been going on for a long time, and stories of mold and flooding problems have often accompanied these units. This is not to say that they are always a bad idea – as long as the hydrology works. Basement apartments on hilltops should be fine. In low-lying areas like Area 4, the Agassiz neighborhood, or much of Cambridgeport or Riverside, or on streets that become watercourses during heavy rains, it seems like a dreadful idea. Whether or not the properties that are the subject of this petition are appropriate for packing in more cash-producing units is a question best left to the engineers. The bigger issue here is the role of mammoth campaign contributions in the approval of this or any other zoning petition.

The letter from Heather Hoffman on this is interesting. The Chestnut Hill Realty petition has been accompanied by mendacity from its inception. It was first billed as "workforce housing" as if to suggest that kitchen workers and housekeepers might be the principal residents of the new units. The re-filed petition asserts that "reasonably priced, affordable studio and one bedroom units" is the basis for their wish for permitting greater density. Ms. Hoffman’s letter calls their bluff by proposing an amendment:

20.650 Affordability. The addition of dwelling units under Section 20.600 shall not result in an increase in the number of market-rate units in the building. A number of units equal to the number of new dwelling units shall become affordable units and comply with all of the affordability, distribution and unit type requirements of Section 11.200. However, only the unit types of the new dwelling units need be considered for this purpose.

Considering past public statements (on the record) by some councillors regarding locating "affordable units" in some of the more high-rent areas of the city, coupled with the fact that said councillors have received significant funds from the petitioners, it should be interesting to hear the ensuing discussion should Ms. Hoffman’s suggested amendment be introduced. Ahh… the sweet smell of mendacity!

Order #2. That all items pending before the City Council and not acted upon by the end of the 2010-2011 Legislative Session be placed in the files of the City Clerk, without prejudice provided that those proposed ordinances which have been passed to a second reading, advertised and listed on the Calendar under "Unfinished Business" during the 2010-2011 City Council term, along with any other pending matters on the Calendar listed as "Unfinished Business," shall be forwarded to the next City Council and further provided that any items pending in committee may, at the discretion of the committee, be forwarded to the next City Council.   Mayor Maher

This is standard procedure at the end of every Council term. Individual councillors can forward items to the new term only in their roles as committee Chairs and members, though the truth is that most Council committees have become primarily one-person affairs where the Chair determines virtually every action undertaken by the committee.

7:00pm   Special Presentation – Mayor’s Red Ribbon Commission on Central Square.  (Sullivan Chamber)

It is perhaps true that every initiative like this one will produce some good results. However, the proliferation of studies and committees on Central Square has been so common that one might suggest that there be created an "Office of Central Square Studies" to house all the reports. The process leading up to this report has not exactly been an open public process, though no one who showed up was ever turned away. From the beginning there were presentations of very specific proposals for the Naggar property at Norfolk St. and Mass. Ave. that seem very much to be the fulfillment of something listed on the Mayor’s Office website during the 2006-2007 term and in the "Office of the Mayor" section of both the FY2007 ("An initiative envisioning a new square in Central Square") and FY2008 ("Envision a new square in Central Square") Budget Books. Will this be the centerpiece of this latest report? – Robert Winters

Highlights of the Oct 17, 2011 Cambridge City Council agenda

First of all, take note that due to an elevator malfunction at City Hall, the City Council will meet this week at the Fitzgerald Auditorium at CRLS, 459 Broadway. There are a few items this week that should bring out the public. City Manager’s Agenda #7 and City Manager’s Agenda #8 are appropriations of $500,000 and $1,190,000 received by Comcast as part of their 2011 Renewal License. I suppose cash is good even when it comes from the continued domination by the Evil Empire.

Resolution #1. Urge residents to participate in Food Day which will take place on Oct 24, 2011.   Vice Mayor Davis

It’s hard to say what exactly Food Day is and this resolution provides scant advice on how residents should participate other than to eat. Seems like I celebrate Food Day every day.

Resolution #23. Happy 80th Birthday wishes to a special Cantabrigian.   Councillor Decker

I’m guessing that this must be Robert Wolf, husband of Alice Wolf, but there are 30 other registered Cambridge voters who turn 80 this month. Happy birthday to all of you.

Order #3. That the Mayor is hereby requested to work with the City Council to schedule a date for a Roundtable meeting to review the census.   Councillor Reeves

In Cambridge, like anywhere else, there is Inside Baseball – the stuff that serious politicos talk about but which rarely makes it to the local press or into the conversations of most residents. When the census occurred a decade ago and was followed by legislative redistricting, Cambridge ended up being carved up like a Thanksgiving turkey. My recollection is that in order to prevent two popular incumbents in Newton from having to face off against each other, several of the principally Cambridge State Rep. districts were sacrificed and made part of districts that were mainly in neighboring towns. We ended up with 6 districts – most of which were nearly impossible for a Cambridge candidate to win. Only the districts of Representatives Toomey and Wolf were held harmless.

Most consequential was the way that the district formerly held by Saundra Graham, Alvin Thompson, and then Jarrett Barrios was scattered. The Inside Baseball story has it that when it became known that Barrios was going to vacate the seat in order to run for State Senate, it was considered OK to not protect that district and that Barrios did nothing to prevent this. At some level, who cares? We end up with 6 state reps. who we can talk to about relevant Cambridge issues instead of, perhaps, 3 all-Cambridge districts. The bitter issue was that aspiring Cambridge political people who might have sought those state seats found their options limited. There are many insiders who are still angry 10 years later at Jarrett Barrios who they blame for the current configuration.

So now it’s census time again. Word has it that the proposed new districts will be revealed this Tuesday, Oct 18. Will the map be redrawn in a manner that benefits some councillors and others who might consider a career move? Stay tuned….

Order #5. That the City Manager is requested to appoint a committee to explore the feasibility of establishing a Cambridge Museum that will serve as repository of Cambridge history.   Councillor Simmons, Councillor Toomey, Councillor Cheung and Mayor Maher

There is no doubt that the need exists and will always exist to have secure locations for the wealth of historical documents and artifacts of our very old and historic city. In addition to the Cambridge Historical Commission and the Cambridge Historical Society, we now also have a Cambridge Room at the new library and a staff archivist. This Order proposes to explore the possibility of creating a new Cambridge Museum in which the public may commune with the city’s history. This is unquestionably a good idea in the long term, but can we sustain all of these historical venues? Where would you locate such a new venue and who would be the target audience? In any case, the idea deserves a complete and critical evaluation – even if the end result is better support and enhancement of the existing venues.

Order #6. That the City Manager is requested to instruct the City Solicitor to prepare language for an ordinance to ban the use of brakeless bikes in Cambridge.   Vice Mayor Davis

See http://www.malegislature.gov/Laws/GeneralLaws/PartI/TitleXIV/Chapter85/Section11b. In particular:

"Every person operating a bicycle upon a way…shall have the right to use all public ways in the commonwealth except limited access or express state highways where signs specifically prohibiting bicycles have been posted, and shall be subject to the traffic laws and regulations of the commonwealth and the special regulations contained in this section, except that: …(3) bicycles may be ridden on sidewalks outside business districts when necessary in the interest of safety, unless otherwise directed by local ordinance." and "Every bicycle operated upon a way shall be equipped with a braking system."

Councillor Davis’ Order is already part of state law and is therefore moot. Whether or not it’s enforced and by whom it is enforced are open questions. Thanks to John Allen for the references.

Order #11. That the City Manager is requested to confer with the Traffic, Parking and Transportation Department and the Community Development Department to investigate how to make the Follen Street/Little Concord Avenue intersection safer for pedestrians, bicyclists and motorists.   Councillor Cheung

Here we go again. The City has made some good decisions regarding bicycle infrastructure and some horrible decisions. The Little Concord Avenue design is poor (see John Allen’s May 16, 2011 critique and his May 20 followup remarks), but not nearly as dreadful as the "cycle track" installed on Vassar Street. The City is now going full speed ahead to implement this same absurd design on Western Avenue (see John Allen’s Oct 27, 2010 remarks and Paul Schimek’s Aug 10, 2010 letter). Pedestrians and cyclists beware.

Order #23. City Council opposition to cuts to Medicare and Medicaid benefits and support of the American Jobs Act.   Councillor Decker

My guess is that two items will bring people out for Public Comment at this meeting. This one will likely bring a few visitors to talk about national politics. The following item (the Bishop Zoning Petition) will likely bring the lion’s share of comment even though it remains in committee and is not before the City Council for action at this meeting.

Committee Report #1. A communication was received from D. Margaret Drury, City Clerk, transmitting a report from Councillor Sam Seidel, Chair of the Ordinance Committee for a public meeting held on Sept 7, 2011 to consider a petition filed by Julia Bishop et al., to amend Section 17.20 of the Zoning Ordinance – Regulations for Special District 2, located in North Cambridge along Linear Park. Proposed amendments include: deletion of allowed non-residential uses; reduction in allowed Floor Area Ratio; increase in required lot area per dwelling unit; reduction in allowed height; new regulations for fences abutting Linear Park.

Perhaps the most interesting aspect of this petition is that the affected area was already rezoned within the past decade (actually Feb 14, 2000) from an industrial zone (due to it being adjacent to a former railroad line) to create Special District SD-2 primarily for the purpose of encouraging the transition toward residential use. Now that this residential use is part of an active proposal, this petition seeks to significantly reduce its density and the owner claims this will destroy its financial viability. Those advocating for this petition are trying very hard to convince the City Council to act on this petition before the November 8 municipal election. The agenda includes 18 Communications in support of the Bishop Petition.

Committee Report #2. A communication was received from Donna P. Lopez, Deputy City Clerk, transmitting a report from Councillor Craig Kelley, Chair of the Transportation, Traffic and Parking Committee for a public meeting held on Oct 6, 2011 to discuss the Austin, Texas "Parking Benefit District Pilot Program" and any other city parking issues.

Contained within this report is a proposal that should infuriate Cambridge residents who own cars and who do not have private driveways or garages. A letter from Chris Summerfield (153 Lexington Ave., but he’s not listed in either the voter database or the 2011 street listing) requests a change to the Traffic, Parking and Transportation regulations that would strictly prohibit parking within 15 feet of the center line of any public or private driveway. This is currently only enforced where necessary and where the vicinity of the driveway is appropriately signed. Councillor Kelley commented that no one is supposed to park ten feet from either side of any driveway – something that may be the practice in Wellesley but one which would eliminate hundreds of parking spaces if enforced in Cambridge.

Though Traffic Director Susan Clippinger stated that you can park 3 feet from the edge of a driveway, everyone knows that this is only enforced where it makes sense to do so. Miraculously, we all seem to get along as long as people can navigate their way in and out of their driveways. Nonetheless Councillor Kelley proposes an Order that would wipe out hundreds of on-street parking opportunities by being overly and unnecessarily restrictive. It’s worth noting that the only people present at this hearing were Councillor Kelley, Sue Clippinger, Deputy City Clerk Donna Lopez, and Chris Summerfield.
