First Pass at the Feb 10, 2020 Cambridge City Council Agenda

Manager’s Agenda #4. Transmitting communication from Louis A. It seems likely that the Tree Removal Moratorium extension will breeze through. Ideally, the Council would at least amend it to allow for some additional flexibility, especially for long-term residents who are simply maintaining their property rather than redeveloping it. Hope springs eternal, but I don’t have much faith that reason will prevail here or when they finally get around to implementing any master plan recommendations.

Unfinished Business #4. That the Cambridge City Council amend the Municipal Ordinances of the City of Cambridge to insert a new Chapter 2.129, entitled “WELCOMING COMMUNITY ORDINANCE” [Passed to a Second Reading on Jan 27, 2020. To Be Ordained on or after Feb 10, 2020.]

I expect this too will breeze through ordination either this week or very soon, but the rhetoric over restrictions on police activities should prove interesting, especially the clarifications from the City Solicitor in the section on the "Role of Police Department in immigration enforcement" to make it consistent with federal statutes.


Order #1. That the City Manager is requested to direct the appropriate City staff to work with the residents of the Agassiz neighborhood in furthering this important neighborhood conversation and in helping make a determination as to how to arrive at an appropriate, official name change for this neighborhood.   Councillor Simmons, Mayor Siddiqui

Cambridge neighborhood names have no real legal standing. Some of them, like Mid-Cambridge, were invented by what was once called the Planning Department back when they were making maps for federal grant programs. So in some sense this is just feel-good stuff. Maybe we should just use Zip Codes to avoid any future historical crisis.

Order #2. That the City Manager is requested to rename the maintenance area within the Ryan Garage at 147 Hampshire Street in honor of Sydney Cox, with this becoming known as the “Sydney James Cox Maintenance Facility”.   Councillor Simmons, Councillor Toomey

This continues what has become a DPW tradition of naming its buildings and facilities for some of our great long-time dedicated DPW employees.

Order #4. That the City Manager is requested to confer with relevant City departments on the feasibility of instituting a program to install rings on parking meters to expand bicycle parking options.   Councillor Nolan, Councillor Sobrinho-Wheeler, Mayor Siddiqui

This has been suggested in the past by me and by others, and the stock answer at the time was that locking bikes to parking meters somehow obstructed access to motor vehicles. Geometry and reality contradict this. The only exception would be bikes with trailers. Maybe we’ll get a different answer this time around.

Order #6. That the City Manager is requested to confer with the Department of Human Services and other relevant departments to determine the feasibility of both expanding the Head Start program hours and adding additional scholarships to improve access to high-quality, early childhood educational resources.   Mayor Siddiqui, Vice Mayor Mallon, Councillor Carlone, Councillor McGovern

The single most important thing we can do to lessen inequality is to support programs like Head Start that help to level the playing field so that residents can one day succeed on their own terms. If somebody wants education we should provide it one way or another.

Order #7. That the City Council go on record calling for the Parliament of India to uphold the Indian constitution by repealing the Citizenship Amendment Act, stopping the National Register of Citizens, and taking steps towards helping refugees by ratifying various UN treaties on refugees.   Councillor Zondervan, Mayor Siddiqui, Councillor Sobrinho-Wheeler, Councillor Nolan

We’re barely one month into this Council term and it’s already looking like we need a change in the City Council Rules to establish a standing Foreign Policy Committee.

This concerns the Alexandria zoning petition to establish a Grand Junction Pathway Overlay District. It is noteworthy in that the petition was likely to die a lonely death unless an alternative site for the proposed Eversource electrical substation on Fulkerson Street could be found. Thanks to the intervention of City Manager Louis DePasquale and others, an alternate site seems to have been identified but not yet revealed. – Robert Winters

On the Agenda – May 14, 2018 Cambridge City Council meeting

First… what’s still Not On the Agenda (even though letters continue to pour in to the City Council commenting on this Non-Order): The HP Divest matter. Wherefore art thou? Perhaps it’s with all the other missing Orders highlighting Bad Behavior (real or perceived) by governments around the world.

On the domestic front, there are these:

Manager’s Agenda #4. A communication transmitted from Louis A. DePasquale, City Manager, relative to Awaiting Report Item Number 18-13, regarding electric vehicles.

It’s an interesting report and it seems like the City is using good sense in knowing when and under what circumstances vehicles should be changed over to all-electric or hybrid-electric. Nobody wants to see a fire engine or police car crap out in an emergency situation because its battery ran down. This report also brings to mind two competing philosophies when it comes to making changes to meet environmental or other goals – the Carrot or the Stick. Some (like me) prefer the carrot to encourage people to make changes, i.e. to provide incentives or offer a convincing argument to make a switch, e.g. to participate in curbside organics collection or to buy efficient vehicles or appliances. Others are all about the stick, e.g. changing the Zoning Ordinance to TELL people what they have to do to be righteous – or else. I have long felt that mandates are what people make when they fail to make a convincing case on the merits.

Charter Right #1. That the City Manager is requested to work with the Traffic, Parking and Transportation Department to develop a small business parking pilot that would allow temporary on-street employee parking during typical daytime operating hours. [Charter Right Exercised By Mayor McGovern.]   Councillor Mallon, Councillor Siddiqui, Councillor Simmons

I’m interested to see where this goes. People seem to have forgotten that there used to be a lot more unregulated spaces around the city, i.e. neither Resident Only nor sporting a parking meter. In fact, it has often been said by the folks at Traffic & Parking that parking meters are installed not for the revenue but rather to ensure sufficient turnover adjacent to businesses. I don’t know that I believe them anymore. What I do remember is that an enormous number of unregulated spaces were changed to regulated spaces during the days of the Interim Parking Freeze because that was one way to get spaces in the Commercial Parking Bank that could be used in the permitting of new commercial development. The deal was that for every two spaces you regulated you could put one in The Bank. Prior to that there were unregulated spaces that were available to people who worked at local businesses or who taught in Cambridge schools. I’m sure some of the anti-vehicle zealots in the Community Development Department would set themselves on fire rather than agree to ease up on any parking restrictions, but simple deregulation of some spaces in some areas (while keeping some time restriction for nonresidents) might actually be a good way to resolve this dilemma.

Order #1. That the City Manager is requested to report back to the City Council by June 11 with an updated schedule for resubmitting a revised draft of the Outdoor Lighting Ordinance that incorporates suggestions from the Light Cambridge Committee.   Vice Mayor Devereux, Councillor Carlone

I was wondering when this would again be brought back into the spotlight. The original idea to tone down lights glaring through bedroom windows was worthwhile (even though it originally – and wrongly – appeared as a proposed zoning amendment rather as a municipal ordinance) before it got clogged up and bogged down by its own details. That and the desire of some people to clamp down on lighting in places where they have no business calling the shots. Indeed, there are some places, e.g. Central Square, that would benefit by the return of some pretty spectacular lighting.

Tree HouseApplications & Petitions #1. A petition was received from Sue Butler, et al, regarding concerns of excessive speed on Clinton Street in mid-Cambridge, requesting the City install three speed bumps or speed platforms along the length of Clinton Street.

Order #3. That the City Manager is requested to explore the possibility of improving road safety conditions on Clinton Street.   Councillor Zondervan, Mayor McGovern, Vice Mayor Devereux, Councillor Carlone

As near as I can tell, it took just one car getting clipped when backing out of a Clinton Street driveway to get this response. There must be some Very Special People living on Clinton Street. To borrow from the statement in this petition, I just want to point out that "there are small children and pets and elderly people" living on probably every street in Cambridge. Perhaps we all deserve to have "three speed bumps or speed platforms" installed along the lengths of all our streets.

Order #4. That the City Manager is requested to complete a tree canopy study based on the April 2018 LiDAR data before the end of 2018, and to complete future LiDAR based studies as frequently as possible, but no more often than once a year.   Councillor Zondervan, Vice Mayor Devereux, Councillor Siddiqui, Councillor Kelley

I do like seeing the data generated by these studies, but I also find it curious how trees have become the defining Cambridge political topic for 2018. From one bandwagon to another, I suppose. I am once again reminded that there are Carrot Councillors and Stick Councillors. Some will prefer to give you encouragement and incentives to preserve trees on your property, while the others will make you hire a lawyer and file a string of permit applications before taking action against your resident Ents. – Robert Winters

The Marcia Deihl bicycling fatality

Cambridge City Councilor Craig Kelley has obtained a copy of the crash reconstruction report in Marcia Deihl’s fatal collision with a truck on March 1, 2015, and posted the report online. I thank Mr. Kelley for performing this public service.

My understanding is that a Freedom of Information Act request was necessary to obtain a copy. That is not as it should be. The public needs to know the how and why of crashes, to avoid them and guide policy.

Quick summary: Deihl rode out of the driveway on Putnam Avenue from Whole Foods, collided with the front bumper of the truck, which was headed east in the lane closest to the driveway, and went under its front wheels. Here. You can see the ghost bike in the image. (It is before the driveway but the crash occurred at or after the driveway.)

Half-trigger warning: this post isn’t relaxing reading and neither is the report, but they don’t include any gruesome images, or except for the last few pages or the report, descriptions more graphic than what you have just read.

So, what about the report?

Unfortunately, the investigation leaves questions unanswered, which it might have answered. Only in the synopsis at the start of the report does the State Police investigator repeat part of the report of Cambridge Officer Sullivan who interviewed the truck driver at the scene. Sullivan’s report says that the driver “checked to his right but didn’t see anything but snow so he started to pull over. He stated as he was pulling over he started to put on his hazard lights. He felt a bump and thought he ran over a snow bank.” He also said that he was pulling over to park and then walk to a construction site to see if it was ready for the dumpster he was carrying.

The report doesn’t raise, or answer, the question whether the driver was looking ahead prior to pulling over, as he was approaching the driveway. There was also no discussion of the role that snowbanks might have played in blocking sight lines. You will probably recall that the winter of 2015 was the snowiest one ever recorded in the Boston area. 94.4 inches had fallen from Jan. 24 through Feb. 22, 2015.

Deihl pulled out of the driveway either just as the truck was passing, or she passed it. The initial point of impact was the front of the truck and — as identified by a GPS recorder in the truck — it was going only 5 mph at that point (slowing to a stop).

One thing that calls out to me in the report is the intensive examination of the truck but cursory examination of the bicycle (p. 12 of the PDF, p. 7 of the report). What if, for example, Deihl’s brakes had failed? Were the steel rims of Deihl’s old English three-speed bicycle wet? Steel rims are as slippery as ice when wet, and rim brakes barely work then. The temperature reached 30 F on the day of the crash, which occurred at 3 PM, but snowmelt might have wetted the rims. Or did the bicycle have a coaster brake, in which case wet rims wouldn’t have been an issue? Did Deihl skid on packed snow or ice? Also the autopsy report is rather perfunctory. Medical condition leading to loss of control? — last page of the PDF. “Bicyclist rideout” crashes like this one are rare after childhood, suggesting to me that something unusual went wrong.

The key to this crash would seem to be why Deihl came out of the driveway and collided with the truck, rather than stopping to let it pass. But the trucker also pulled over to the right — Deihl may have turned right assuming that the truck would clear her. — page 9 of the PDF.

Deihl was required under the law to yield to traffic in the street before entering it from a driveway. If she pulled out of the driveway ahead of the truck, the trucker could have prevented the crash as long as it was not too late for him to avoid the collision by braking or swerving. He was at fault if he failed to look. If Deihl was passing him on the right, she would have been close to the side of the truck and probably in its right-side blind spot. And sight lines may have been blocked by a snowbank.

It’s incredibly frustrating that:

  1. The investigator didn’t know what he is doing in a bicycle investigation (scenario repeated with the Anita Kurmann fatality in Boston later the same year);
  2. It took a FOIA request to see the report;
  3. Advocates use these tragedies to justify whatever pet projects they have. (Sideguards, says Alex Epstein. They would be irrelevant in this collision with the front of a truck: more about them here. Separate bike traffic from car traffic, says Pete Stidman. Just how would a sidepath have worked on a day when the street was lined with snowbanks is another valid question. Most likely, it would not have been usable. Comments by Epstein and Stidman are here. Neither of them had seen the report when they made their observations.)
  4. Advocates are avoiding adequately informing bicyclists about the hazards of trucks and how to avoid them.

Well, the advocates at the American Bicycling Education Association are an important exception. I am proud to be an instructor in its program. Not left, Felton

OK, I couldn’t resist the palindrome, but this is a serious post anyway.

I nearly left-crossed another cyclist today, on my bicycle, as I turned left from Cambridge Street onto Felton Street. It could have been a very serious collision. He came storming out of the shadows past the black parked SUV in the photo, on the new separated bikeway. I wasn’t looking in his direction at the right time to see him in time to yield. (I had to look in different directions to yield to street traffic, sidewalk traffic in both directions, crosswalk traffic — and now, this parking-screened conflict. “He came out of nowhere,” someone else might say but the Transporters in Star Trek are fiction: he came from where not visible in time reliably to allow yielding.) The short stretch where parking is prohibited before the intersection is supposed to make it possible for left-turning drivers to yield. The bikeway is really only designed for bicyclists riding slowly. It doesn’t work to yield to a cyclist going 20-25 mph.

Startled, I yelled WHOAH! as I crossed just in front of him. He yelled back “I have the right of way.”

His sense of entitlement doesn’t exactly reflect prudence, but if I’d collided with him, I would have been held at fault.

In 45 years bicycling in Boston-area urban traffic, I’ve never collided with a motor vehicle, but I’ve had a couple of near-collisions with other cyclists: both in Cambridge, both at night: a near head-on on the path along Memorial Drive in front of the MIT dorms — the other cyclist had no headlight; the other, I was riding westbound on Harvard Street and a cyclist traveling the wrong way on Dana Street or Ellery street crossed at speed a couple of feet in front of me — also, no headlight.

The new installation on Cambridge Street gives bicyclists the sense of entitlement to enter intersections from screened conflicts, at speed. Bicyclists and motorists turning left here need to be extra-cautious. I don’t see how it would be even possible for the driver of a long vehicle turning left to see a bicyclist in the bikeway in time to yield.

Bicyclists riding fast are much safer riding with the motor traffic, but now the travel lanes are too narrow for motorists to pass bicyclists, and only the very strongest bicyclists (or those with electrical assist) are able to ride fast enough that motorists won’t want to pass.

I was on my way to the Bow Tie Ride when this incident occurred. The Bow Tie Ride was a tame affair indeed, average speed around 5 miles per hour due to the large number of participants of varying abilities. Traffic management by the Cambridge Police and volunteers was very good, but I didn’t have time to finish the ride at that speed and left partway through.

City of Cambridge Declares Snow Emergency Parking Ban – to be lifted at 7:00am, Wed, Mar 15

City of Cambridge Lifts Snow Emergency Parking Ban Ban lifted as of 7:00am on Wednesday;
Trash/recycling collection 1 day behind schedule

The Snow Emergency Parking Ban in effect will be lifted in the City of Cambridge as of 7:00am on Wed, Mar 15, 2017. Tow operations will continue until the ban is lifted.

Residents parked in one of the City’s Snow Emergency Off-Street Parking locations should exit within 2 hours after it has been lifted to avoid being charged. Residents parked at the 52 Oxford Garage must exit within 2 hours of the ban being lifted.City Seal

Due to icy conditions caused by the storm, people are urged to stay off the roads tonight. If travel is required, please use extra caution and leave additional distance between other vehicles and snow crews.

City of Cambridge offices, programs, and library branches will be open on Wednesday. Because curbside trash and recycling pickup was canceled on Tuesday, pickup routes will be delayed 1 day for the remainder of the week.

The Department of Public Works (DPW) will continue to clear streets throughout the night, starting with major arteries. Crews will also be working to remove downed trees. Your patience and participation in clearing sidewalks helps the City return streets and sidewalks to safe, passable conditions as quickly as possible. After major street clearing operations have been completed, crews will begin working on high traffic bus routes to clear snow from bus stops, ramps, and crosswalks.

City Ordinance requires property owners to remove snow from sidewalks next to their property or business within 12 hours of daytime snowfall and before 1:00pm when it has fallen overnight. Property owners must also remove or melt all ice within 6 hours of the time it forms. There is a $50 fine for each day of non-compliance. Property owners are asked that when shoveling their sidewalks to please maintain a minimum of 36 inches clear width, so that people who use wheelchairs and other mobility devices (also parents using strollers, etc.) can navigate the sidewalk. The Cambridge Commission for Persons with Disabilities (CCPD) requests that a 48 inch clear width be created when possible – this gives an extra measure of safety. Additionally, CCPD urges residents and businesses to pay particular attention to the corners, where one sidewalk meets another – shovel the full length and width of curb ramps, so that pedestrians with disabilities can get to the crosswalks. Business owners are requested, if there is a disability parking space on the street near your storefront, to please take the extra time to shovel a clear path to that space, so that your customers with disabilities can visit your establishment. In particular, shovel a space wide enough so that vans with lifts can deploy the lift onto the sidewalk.

The City recognizes the effort that goes into shoveling out any vehicle parked on a city street during a snow event. However, residents may not use objects such as trash/recycling barrels, furniture items or any other item to save parking spots on public streets. These items will be treated as trash and disposed of by DPW.

Mar 13, 2017 – A Snow Emergency Parking Ban will go into effect in the City of Cambridge beginning at 7:00am on Tues, Mar 14, 2017. Vehicles parked on streets that are signed “No Parking during a Snow Emergency” will be ticketed and towed until the ban is lifted.Snow on Broadway

There will be no curbside trash or recycling collection on Tues, Mar 14 because of weather conditions. All curbside trash and recycling daily pickup routes will be one day behind schedule for the remainder of this week.

The Cambridge Public Schools will be closed on Tues, Mar 14, 2017.

Updated information will be available at CambridgeMA.GOV/Snow throughout the storm. In addition, the public is encouraged to follow updates on Twitter at @CambMA and on Facebook at CambridgeMA.Gov. The City will be utilizing the hash tag #CambMASnow on Twitter to help the public follow the conversation.

Below is important information from the City:

  • A Snow Emergency Parking Ban is effective as of 7:00am on Tuesday, March 14, 2017 and vehicles parked on streets that are signed “No Parking during a Snow Emergency” will be ticketed and towed at that time until the ban is lifted.
  • To assist residents in parking their vehicles, free parking is provided at a number of facilities beginning at 6:00pm on Mon, Mar 13, 2017. The 52 Oxford St. Garage will allow parking at 8:00pm. A listing of facilities that provide free parking during snow emergencies, is available at: CambridgeMA.GOV/Snow.
  • Always park at least 20 feet from the street corner. Parking this far away from the corner improves visibility and safety year-round and ensures compliance with Cambridge Traffic Regulations. In the winter, it also allows plows to push snow away from crosswalks.
  • Ice needs to be removed within 6 hours from the time it forms, per City Ordinance. Snow needs to be removed within 12 hours after snow stops falling during the day and before 1:00pm if it snowed during the night, per City Ordinance.
